On February 10, 2003, JLC gave permission to Will Foy for shows to be hosted at the Archive, with the caveat that some shows may be considered for release and should not be archived:

The etree business is serious. Thanks for the links. Glad to know that we'll be in such good company. As you know, we've always allowed taping and trading of shows. We've never allowed video, for reasons that are sometimes complicated for even us to understand, but I think that even that in certain (expressly asked for permission) can be arranged. We did switch from allowing board tapes to only audio mics a few years ago, partly because it was a recommendation of our current sound engineer, but also because we do agree that if our sound guy is worth is/her salt, you'll always get a better tape with live mics. Mic stands, with certain exclusions, are also allowed. There are rare occasions when we do not allow taping for certain "special" shows. We will make this clear on our website, and if there's even a space at etree to do this, it would be nice.

We really appreciate that the policies for all bands are upheld by etree's own stipulations. This means that it goes without saying for us that if anything was sold, we'd be very...sad. But this has never been a problem with our fans, and we hope it never is.

So we hereby heartily give our permission to be a part of your live internet trading organization! and we're very honored to be asked.

Update 4/03 excerpts from Matt B to Diana:
"As of now, there are no off-limit shows.... If an off-limit show comes up, we'll immediately tell Rich, Will and you, and no harm will be done. But until then...happy taping.

"One more thing...could you add that we're not crazy about videotape? I've meant to put it on our site, and will soon... if we get the word out that would be great. ...[We're] a 'no video' band."

Our Official Word on the Taping of Shows

Recently we've been approached by an organization called etree.org, which has set up a Live Music Archive here. After a lengthy perusal, we've found etree to be a good thing, and it puts us in the company of other great musicians, like our friends in Gomachi, and Guster, and Jason Mraz, and Howie Day. At the Live Music Archive you can find entire shows, recorded in the manner that the artist chooses (board tapes, live audio mics, etc.) and, if you've got the high speed, you can download and listen to a concert that you missed, or wanted to hear again, or just hear more from a band that you really love.

The selling of a recorded live show of a band without the band's permission is called "bootlegging". This is bad. Bad for the band, because they work very hard to survive and don't need for someone else to make money off of them...that happens too much anyway. But it's also bad for the bootlegger...if they're caught, they can lose their house, their car, and even their grandmother. We've heard stories of folks that drove to a show, hawked a few handmade CD's for some cash, and were left in the parking lot as the actual band members drove away in their car, after they were caught bootlegging. Bootlegging, like scalping tickets, is just plain nasty.

But the reason that etree.org needs our permission to do this because this is a free service. This is trading at it's most high-tech, and almost immediate gratification to you traders. We gave our permission to etree and folk so that those of you far away from shows or those that wanted to reminisce could do so, as long as someone was there taping the show! All for free. Trading isn't nasty.

Our official taping policy, since 1998, is this: we have always allowed the recording and trading of our live shows. For a while we allowed "board tapes", which involved the taper actually plugging into the sound board and getting a mix there, but the quality was uncontrollable and sometimes it was too much trouble for our sound engineer. So we now allow audio microphone taping of our shows. Bring a mic or two to a show, and you can make a recording. There are plenty of resources out there on what you need to get started, if you are interested in being a "taper". The better your setup, the better your recording, the more friends you have. It's that simple.

More recently, we've decided to record some of our shows, ourselves. This is for a project that we're working on, one that we plan to launch in the next few months. When we decide to tape a show, we won't offer that show to etree.org, but will make it very clear at this website of our intentions. At some point we plan to implement a "trading page" of this site, just so it's all very clear and organized, but until then, if you tape a show, just check with the "news" section of this site to make sure we're not going to be taping the show ourselves.

But tapers, don't worry...our taping of a show will happen very rarely. In the meantime, grab your gear, come to a show, introduce yourself to Herbie (or our most current sound engineer), and start taping. We do allow microphone stands, as long as there is room for the other people in the house to rock, so be curteous to others and tape and trade away!
