10/2005 Stolen gear update, good news: Reportedly a substantial portion of gear from 5/2005 theft has turned up and is being recovered!
On February 21, 2003, the Mermen gave permission to Bill Gardner for shows to be hosted at the Archive:

The usual disclaimer being not for profit etc. Below is the taping
policy I wrote up for them a couple months ago.
>The Mermen allow all forms of recording (soundboard/audience audio,
video) from any location within a venue, subject to venue or event
restrictions and logistical considerations. Recording and distribution
of Mermen performances is authorized on a non-profit, non-commercial
basis, and unauthorized sale, duplication, and or distribution of Mermen
recordings is strictly prohibited. The Mermen retain all copyright and
trademark rights to Mermen performances and recordings, and reserve the
right to revoke this recording privilege at any time. Any questions or
concerns regarding this taping policy should be directed to the band's
archivist, Steve Brown, at steve AT mermen DOT net .<

12/16/04, re companion lossy copies, Steve replied for band in general and for his own tapes specifically:
It's not a problem for me or the band as long as the lossy versions are
labelled as such. I make the occasional mp3 and throw it up in the yahoo
group files section [of groups.yahoo.com/group/mermenlist]... So - mp3 away!
