PKEAMBLE.

Whereas, Experience lias taught us (the mem- bers of this organiaation) that tho dangers to which we are continually exposed are, unfortunately, too fully verified by the serious and often fatal acci- dents that occur in our vocations, and that benefits in many of these cases are positively necessary; and whereas, " the Laborer is worthy of his hire," proportionate to the dangerous and laborious na- ture of his employment; and that it is as much to the interests of the Stockholders and Managers of those vocations to retain experienced labor as for the Laborers to receive their just recompense ; and whereas, an organization having for its objects the maintenance of these principles and the dissemina- tion of the knowledge of "practical experience," is not only a benefit to its members, but to the com- munity generally; therefore, that these ends may be attained, we have resolved to form an associa- tion having for its motto : ' 'Justice to all live and let live " and pledge ourselves to be governed by the following Constitution and By-Laws:

CONSTITUTION

OF

Globe City Union

ARTICLE I.

NAMK, TITLE AND COMPOSITION.

Section 1. This Association shall be known and desiguated' by the name and title of "The Globe City Union, of the Town of Globe, Arizona," which shall be composed of " Miners, Smelters and Mill- men," who shall be admitted to membership therein according to the articles and provisions of this Constitution.

Sec. 2. This Union shall not be dissolved so long as fifteen members in good standing object thereto.

Sec. 3. The object of thisITnion shall be to visit the sick, bury the dead, the elevation of the posi- tion, and the maintenance of the rights of its mem- bers.

ARTICLE 11.

MEMBERSHIP.

Section 1. All candidates for initiation must be men of good moral character, residents of Globe and vicinity, and are known as workmen at the time of application.

Sbc. 2. Every candidate for membership must be proposed by one member of the Union, and

seconded by another, who can speak advisedly as to his qualifications, and it shall require a majority of all present to elect, the vote to be by acclamation. Sec. 3. Every member, at the time of his initia- tion, shall pay a'^fee of five ($5) dollars, and sign his name in full to this Constitution.

ARTICLE III.

Section 1. The ofl&cers of this Union shall con- sist of a President, Vice-President, Recording Secretary, Financial Secretary, Treasurer, Conduc- tor, Warden, Fi^e Trustees, a Standing Committee of three for financial business, all of whom shall serve for six months (except the Trustees, who shall serve (12) twelve months), and shall be elected by a majority of all the members present, the vote to be by written ballots.

Sec. 2. All candidates for ofl&ce shall be clear of financial charges on the books at the time of their nomination.

Sec. 3. Vacancies occurring in any elective office shall be filled by the presiding officer p?;o tern., for the evening, and under the head of " New busi- ness," nominations shall be entered into for the said office, and at the next regular meeting an elec- tion shall be had, the same rules governing as at the general election.

ARTICLE IV.

FUNDS AND BENEFIT-o.

Section 1. The funds of this Union shall not be divided among the members, but shall remain the property of the Union, for its legitimate pur- poses, so long as fifteen members are willing to continue in it.

Ski-. 3. The deposit shall be placed to the credit of the '* Trustees of the Globe City Union."

Sec. 4. No portion of said deposit shall be drawn out of bank except upon the order of the full Boai-d of Trustees, attested by the seal of the Union, together with the counter-signatures of the Kecording Secretary and President.

Sec. 5. Should the d^osit be made in any bank outside the limits of this Temtory, the Trus- tees. President, and Recording Secretary shall for- ward their own proper signatures, together with the attestation of a Notary Public or Commis- sioner of Deeds, as to their genuineness; the ex- l)ense of same to be paid out of the funds of this Union.

Sec. 6. Benefits shall be regulated by the By- Laws of this Union.

ARTICLE V.

Section 1. Any member of this Union who shall, in any way, violate any of the principles of this Union, or offend against any article or section of this Constitution, By-Laws, or Rules of Order, shall be fined, suspended, or expelled, as the By- Laws or Constitution may direct, or the Union may determine.

Sec. 2. Every member shall be entitled to a fair

trial for any offense inrolving suspension or expul- sion.

No member shall be put upon trial unless charges duly specifying the offense are made, so as to fully apprise him of the nature thereof, and to enable him to prepare for his defense.

It shall be brought in writing and signed by a member of this Union making such charge or charges.

Sec. 3, Such charge shall be referred to a com- mittee of five members, in good standing, who shall without delay, summon the party and try the cause. And they shall keep full minutes of the proceedings, the evidence, pro and con, which they shall report to the Unjpn forthAvith, together with their decision on the charge, which the Union shall confirm or not, as the majority shall determine.

Sec. 4. If the accused shall neglect or refuse to stand his trial, when duly summoned, the Commit- tee shall report him "guilty," which report shall be final.

AETICLE VI.

Section 1. A member of this Union, wishing to remove to a point remote, shall, upon making ap- plication, either personally or in WT.'iting, be granted a " Card of withdrawal," upon the payment of all indebtedness due the Union up to the time of ap- plication for said card, and the Financial Secretary shall issue said cards to applicants who comply with this section.

Sec. 2. A member who may desire to change his membership to some other Union, shall, upon application to the Union, be granted a clearance

certificate, npon the payment in full of all indebt- edness due the Union up to the time of making ap- plication.

Sec. 3. Clearance certificates shall be received upon deposit in the Union by a majority vote of all members present in good standing; the holder thereof«fiigning the Constitution and By-Laws.

ARTICLE VII.

Section 1. This Constitution shall not be al- tered or amended, except at a regular meeting of the Union, and >\'ith the concurrence of two-thirds of all the members present. Notice of the intended alteration or amendment must be given in writing, at a meeting one week previous to the action of the Union therfoii.

ARTICLE 1.

MEETINGS.

Section 1. The regular meetings of this Union shall be held on Wednesday evening of each week, at the Union's regular hall, at Globe, and the Standing Committee shall meet whenever called upon by the President, or notified by him through the Recording Secretary.

Sec. 2, The regular hour of meetings of the Union shall be at 7 o'clock and 30 minutes, p. m.

Sec. 3. At the hour of meeting, if a quorum be present, the President shall call the meeting to or- der by three raps of his gavel, which shall be an- swered by the Vice President in like manner, when the Union shall proceed to business. Should there be no quorum, the meeting shall be adjourned un- til the time for holding the next regular meeting.

Sec. 4. Ten members shall constitute a quorum, including the officers of the Union.

ARTICLE II.

He shall decide ail questions of order, subject to an appeal to the Union. He shall have the right to vote at the election of otiicers; and, when tht* members are equally divided, he shall have the casting vote on any question. He shall sign all orders drawn on the Treasurer as shall be ordered t<» be paid by the Recording Secretary, in compliance with a vote of the nuijority of all members preseiit, at any stated meeting. He shall have power to call meetings whenever he deems it necessary, or when required by ten or more members in writing, aud perform such otlier duties as the Union nuiy require. The President shall take no part in any debate while in. the chair, but may call the Vice-President to the chair when he wishes to discuss any question; and he shall appoint the majority of all committees not otherwise provided for by the Union.

Sec. 2. The President shall receive the sum of four dollars ($4.00) per day, from the funds of the Union for each and every day he loses in attending funerals.

Sec. 3. It shall be the duty of the President to initiate candidates for membershij) but once on each regular night of meeting, and in no case shall* the initiation ceremony be repeated on the same evening unless on motion that the rules of order be suspended for that special purpose.

DUTIES OF THE VICE-PBESIDKNT,

Sec. 4, The Vice-President shall assist the President during the meetings of the Union, aid him in the proper discharge of the dutes of his

office, appoint the minority of all committees not otherwise provided for by the Union, receive from the hands of the Recording Secretary all warrants drawn by vote of the Union, and place the same in possession of those in whose favor they are drawn, preside during the absence of the President and perform all duties devolving upon that officer.

DUriKS OF KECOKDING SECEETAKY.

Sec, 5. The Recording Secretary shall keep on record, accurately, the minutes of the Union with their proceedings. He shall issue all summons or notices required, and give them to the Warden to be served; furnish the Treasurer with copies of all warrants or resolutions authorizing drafts on him with the signature of the presiding officer, and the imprint of the seal of the Union attached thereto. He shall present a full report of all receipts and disbursements, together with such other information as may be shown by his books and required by the Union at the end of each quarter: notifj^ every committee of their appointment and the subject referred to them, and at all times have his books prepared for investigation by the Finance Commit- tee. He shall, at the end of his official term, turn over to his successor in office all books, documents, or other property in his possession belonging to the Union.

ARTICLE III.

DUTIES or FINANCIAL, SECRETARY.

Section 1 . It shall be the duty of the Financial Secretary to keep just and due accounts between the Union and its members. He shall receive all initiation fees, dues, fines, and other moneys, and pay over the same to the Treasurer, taking his

DUTIES OF TREASURER.

Sec. 5. The Treasurer shall receive from the hands of the Financial Secretary all moneys col- lected by him, pay all orders drawn on him by vote of the Union, attested by the signature of the Re- cording Secretary and seal of the Union, and bear- ing the counter-signature of the President.

DUTIES OF WABDEN.

Sec. 6. The Warden shall have charge of the door of the Union, and see that none but members enter the rooms of the Union, and permit no mem- ber to pass out without the retiring passM'ord.

DUTIES OF CONDUCTOR .

Sec. 7. The Conductor shall examine every person in the room jarior to opening, see that he is correct in the password; report to the President all those not correct in the password. He shall report the names of all candidates in waiting for initia- tion, and introduce them to the President when so instructed, and perform such other duties as may be necessary for the comfort of candidates and members.

DUTIES OF FINANCIAL COMMITTEE.

Sec. 8. It shall be the duty of the Financial Committee to audit all books, accounts, vouchers and the reports of the several officers of this Un- ion at the end of every quarter, or at any time when such matters may be referred to them, and report to the Union in writing, said report to be acted upon as all other reports, by a majority vote of the Union.

AKTICLE IV.

ELECTION OF OFFICERS.

Section 1. The election of officers shall be by ballot, and shall be held on the first Wednesday in June and December of each year. It will require a majority of all the votes polled to elect. Notice

of elections shall be published in one weekly paper in the County of Gila, one week prior to the election.

Sec. 2. Thp President shall call the meeting to order, whtii he will api>oint two tellers, whose duty it shall be to conduct the election. They shall collect and count the ballots, and make due report to the President, who shall then report the result to the Union. No business but the election of officers shall be transacted at semi-annual meet- ings herein proWded. Balloting shall commence at 8 p. M.

NOMIN.KTIONS.

Skc. 3. All nominations for the election of offi- cei-s shall be made one week previous to election, and in no case shall they be made on the night of election, and no town, county or State officer, foreman or clerk of any company or corporation, shall be nominated or hold any office in this Union.

ARTICLE V.

PASSWORD.

Section 1. The President shall, at the end of every two months, change the password, or oftener in case of emergency; he shall authorize and em- power the Financial Secretary to communicate the word to every member when he signs the Constitu- tion and Bj'-Laws, and to every member in good standing, and this password shall not be used for any i)urpos«' whatever, except to gain admission to the Union.

ARTICLE VI.

DUES, FINES AND PENALTIES.

Section 1. Each member shall pay into the

general fund of this Union, (m dues, one dollar each month.

Sec, 2. The Financial Secretai-y shall not re- ceive any dues from members, unless they present their card of membership.

Sec. 3. Any officer who shall fail to be in meet- iug at roll call shall be fined fifty cents; and if he is absent three whole evenings successively, another member may be chosen for the rest of his term.

Sec, 4. Any member who shall be appointed on a committee and fails to properly discharge his duties, shall be fined fifty cents.

Sec. 5. The Eecording Secretary shall be sub- ject to a fine of fifty cents for neglecting to perform the duties of his office.

Sec, 6, The Treasurer and Finance Committee shall each be fined two dollars and fifty cents for neglecting to make out their quarterly reports.

Sec. 7. No member who is under the influence of liquor shall be allowed to introduce or second motions, or vote on any matter connected with this Union; and further be it resolved, that any mem- ber coming into this meeting in an inebriated state, or using profane language, shall be expelled from the room "and fined two dollars and fifty cents " for the evening, and the fine to be repeated for each and every offence.

If any member divulge the name of any member or members, or any of the business or pro- ceedings, or think proper to divulge the name of a member who shall speak against any candidate pro- posed for membership, or make public any of the passwords, grips or signs of this Union, he or they shall be expelled.

Sko. 9. Au excuse deemed sufficient by a major- ity of all the meniVjers present shall always be re.- ceived in remission of any tine incurred; and sick- ness, or at work, will be a lawful excuse.

VIOLATION OF LAWS.

Skc. 10. Any brother knowing any member to violate any section of the Constitution or By-Laws, it will be his duty to report the same at the next regular meeting; in default thereof he or they shall be dealt with as the Union may determine.

Sec. 11. Should it be known that any member cast an illegal vote he shall be fined tive dollars.

UCTIES OF VLSITINO COMMITTEES.

Section 1 . It shall be the duty of the President to appoint, at the first meeting of each month, a Visiting Committee, whose duty it shall be to visit the sick and those injured at work, and report in writing at the next regular meeting.

Sec. 2. It shall be the duty of the Visiting Com- mittee to keep a receipt book, and make all the members receiving the sick benefits sign a separate receipt for each and every sum of money they may from time to time receive.

Sec. 3. Any member claiming benefits from this Union must furnish the Visiting Committee with a medica' certificate from some known physi- cian; and in no case shall the benefits be granted in the absence of said certificate.

ARTICLE VIII.

OOOD STANDING AND SICK BKNEPITS,

Section 1 . No member of this Union two months

Sec. 2. Any person who has been a member of this Union two months and is in good standing, who by sickness or accident may be rendered in- capable of following his usual vocation, shall re- ceive from the funds of this union the sum of eight dollars per week for a period not to exceed ten weeks in an}^ one year, excepting a member who may have bones broken or receive great bodily in- jury; and in no case shall a member receive more than one year's weekly benefits from this Union. No benefits shall be granted in any case when it shall be known that the sickness or injury was caused by intemperance, imprudence, or immoral conduct, or a disease known to exist in the member prior to his admission into this Union.

Sec. 3. Members who have received the full yearly benefits in any case shall not be entitled to benefits again until twelve months have elapsed from the payment of the last benefit.

Sec. 4. Benefits shall not be allowed for the first week's sickness or disability.

ARTICLE IX.

FUNEEAIi BENEFITS AND BURIAL OF MEMBEES.

Section 1 . All members who sign the Constitu- tion and By-Laws and are not two months in arrears, shall be entitled to funeral benefits.

Sec. 2. The burial of a deceased member shall be under the supervision of the President, assisted by the subordinate officers of the Union. He shall advertise the place of each funeral in at least one weekly paper of the town.

S«c. 3. It will be the duty of the President to notify all numbers to attend the funeral, and they shall assist in rscortin^' the remains t(» the ont-skirts of the town. '

Skc. 4. On the death of a member in Rood standing the sum of fifty dollars shall be allowed as a funeral benefit.

Sec. 5. In the absence of a competent relative the President shall apply sufficient of the amount for burial expenses, and if any remain it shall be returned to the Union together with the receipts of the expenses.

ARTICLE X.

RKINSTATKMENT.

Section 1. A member can be reinstated into this Union only upon the payment in full of all indebtedness due at the time he ceased to be a member. A motion to reinstate shall be made and seconded by at least one member in good standing, and lay on the taible for one week, when, if a majority vote in favor thereof, he shall be restored to full membership, but shall sign the Constitution and By-Laws as in the case of a candidate for initiation.

AllTICLE XI.

DUTIES OF TRUSTEES.

Section 1. At the general election on the first Wednesday in June of each year, there shall be elected five members in good standing, to act as Trustees, with power to act for the good and wel- fare of the Union. Their acts are to Imj subject to the approval of tlie Union.

by resignation, expulsion or any cause whatever, it shall be the duty of the Union to proceed to fill such vacancits immediately, in accordance with the law governing such matters.

Sec. 3. It shall be the duty of the Trustees to hold in" trust the real estate of this Union, for its own proper uses and purposes, and to perform such other duties as the Union see proper to im- pose on them from time to time. They shall re- port to the Union quarterly in writing, the true condition of all property under their care, and make such suggestions as they may deem exped- ient; and at the end of their terni of pffice they shall turn over to their successors in office, all property and books in their possession belonging to the Union.

AKTICLE XII.

HOW TO AMEND BY-LAWS.

Section 1 . These By-Laws may be amended by a vote of two-thirds of the members present at a reg- ular meeting of the Union; provided, that notice be given one week previous to the action of the Union thereon.

1. During the continuance of the meeting silepce musf be observed— the officei-s and mem- bers retaining their respective seats, and no one leaving the room without the permission of the President or Vice-President.

2. No member shall, by conversation or other- wise, interrupt the business of the Union, or refuse to obey the chair.

3. The president, while presiding, will state every question coming before the Union, and im- mediately before putting it to vote shall ask: "Are you ready for the question ? ' ' Should no member rise to speak, or by silence indicate their readiness, he shall rise to take the question; and after he has risen no member shall be permitted to speak upon it. He shall pronounce the result or decision of the Union upon all subjects.

4. Every member, when he speaks or otters a motion, shall rise, and respectfully address the pre- siding officer; while speaking he shall confine him- self to the question under debate, avoiding all jjer- sonality and indecorous language as well as any reflection upon the Union or its members.

5 . Should two or more members rise to speak at the same time, the Chair shall decide who is en- titled to the floor.

6. No member shall disturb another in his speech, unless to call him to order for words spoken.

7. If a member while speaking', shall he called to order, at the reqiiefit of the Chair he Khali cease speaking aud take his seat until the qiiestiou of order is determined, when, if permitted, he may proceed again.

8. No member shall speak more than once on the same question until I all the members wishing to speak shall have had an opportunity to do so, nor more than twice without permission of the Chair.

9. When any communication, petition or mem- oiial is presented, before it is read a brief state- ment of its contents shall be made by the intro- ducer to the Chair.

iO. No motion shall be subject to action unless seconded and stated by the Chair.

11. Any member may call for a division of a question when the sense will admit of it.

12. When a question is before the Union, no motion shall be received, unless to close the pre- vious question, to lay on the table, to postpone indefinitely, to postpone to a certain time, to refer, to amend, and shall have precedence in the order herein arranged, and the three first of which shall be decided without debate.

13. After any question, except one of indefinite postponement, has been decided, any two members who voted in the majority, may, at tte same meeting, move for a reconsideration thereof.

14. Members present can vote on any question before the Union, provided they are in good sUind- ing.

22 RULES OF ORDER.

15. No amendment shall be received except it be in writing.

16. All questions not provided for by the Con- stitution, By-Laws, Rules of Order, or by the gen- eral laws of the Union, shall be determined by a majority of the members at a regular meeting.

17. These rules may be suspended for a special purpose by a vote of two-thirds of the members present.
