The Government’s argument appears in its response brief on page 26, note 4, and asserts that Angov did not “specifically raise” this issue to the Board, leaving it unexhausted. Counsel shall be prepared to demonstrate from the record how and where this issue was presented to the Board for resolution. See Lin v. U.S. Dep’t of Justice, 459 F.3d 255 (2d Cir. 2006); A.R. 7-19; A.R. 453-56. Counsel also shall demonstrate how and where this issue was raised before the immigration judge. A.R. 65-86. The parties also shall be prepared to discuss at oral argument (1) Banat v. Holder, 557 F.3d 886 (8th Cir. 2009); (2) Borovikova v. U.S. Dep’t of Justice, 435 F.3d 151, 157-58 (2d Cir. 2006); and (3) the relevance, if any, of the “Cooper Memo”1 for evaluating the admissibility of the Bunton Letter. Lin, 459 F.3d at 263-72.
