After considering the papers filed, the Court tentative order is as follows: (1) DENY Plaintiff request for liquidated damages of $1,149,334. The Court finds that it has the discretion to make a liquidated damages award on Plaintiffs retaliation claim pursuant to 29 USC section 216(b). The $100,744 total past economic damages already awarded to Plaintiff provided sufficient compensation for the delay in payment of wages and adequately furthered the purposes of the FLSAs anti-retaliation provision. (2) GRANT Plaintiffs request for an attorneys fees award of $315,115.00 for a total of 611.75 hours worked and DENY Plaintiff request for a multiplier of 3.0. The Court finds that a total of 611.75 hours was reasonably expended by Plaintiffs attorneys, and Plaintiff has provided adequate support for the hourly rates requested. However, Plaintiff has not adequately shown that a multiplier of 3.0 is "necessary to the determination of a reasonable fee." Blum v. Stenson, 465 US 866, 898 (1984).
