2008-01-15 9 0 Order ORDER: Accordingly, to facilitate the handling of this petition, it is ORDERED as follows: Petitioner shall file within 90 days, by no later than April 14,2008, all medical records from the period of the vaccinee's birth through either, whichever date is later, the date of petition filing or the date of the vaccinee's initial diagnosis of autism, autism spectrum disorder, a speech or language delay related to an autism diagnosis, or any similar neurological disorder related to an autism diagnosis;and Respondent shall file within 45 days,subsequent to petitioner's medical records being filed, a Statement Regarding whether the Claim should proceed in OAP." If respondent does not believe the records demonstrate the claim is appropriate for futher processing, respondent will explain his position with sufficient particularity to allow the petitioner an opportunity to respond and, if appropriate, correct any deficiencies with additional evidence. In particular, if respondent contends that petitioner has not demonstrated that his or her petition was timely filed in compliance with the Vaccine Act's statue of limitations, respondent will identify those medical records forming the basis of respondent's opinion.
