2017-04-17 26 0 ORDER DISMISSING COMPLAINT. Rule 4(m) of the Federal Rules of Civil Procedure provides that "[i]f a defendant is not served within 90 days after the complaint is filed, the court--on motion or on its own after notice to the plaintiff--must dismiss the action without prejudice against that defendant or order that service be made within a specified time." This action was filed more than 90 days ago on July 26, 2016, but the docket does not reflect that defendant has been served. On March 9, 2017, the Court ordered plaintiff to file any amended complaint and serve that complaint by March 30, 2017, and on March 31, 2017, the Court granted an additional extension of time to serve the complaint until April 14, 2017. Because the due date of April 14, 2017, has come and gone without indication of any service of the complaint, this action is hereby DISMISSED pursuant to Fed. R. Civ. P. 4(m), and the Clerk of Court shall close this case. It is so ordered. Signed by Judge Jeffrey A. Meyer on 4/17/2017. (Gruber, Sarah) (Entered: 04/17/2017)
