The Court, having reviewed Defendants State of Hawai`i ("State"), State of Hawai`i Department of Public Safety, and Michael Gribbin's (collectively "State Defendants") Motion for Protective Order and In-Camera Review, filed June 21, 2005 ("Motion"), Plaintiff Michael Alvarez's ("Plaintiff") memorandum in opposition, filed June 24, 2005, and State Defendant's reply memorandum, filed June 27, 2005, hereby informs the parties of its inclination to DENY the Motion as indicated below. State Defendants filed the Motion pursuant to Rule 45 of the Federal Rules of Civil Procedure. [Motion at 1.] Under Rule 45(c)(3)(A)(iii), the Court may quash or modify Plaintiff's subpoena if it "requires disclosure of privileged or other protected matter and no exception or waiver applies[.]" Fed. R. Civ. P. 45(c)(3)(A)(iii). Rule 45, however, does not provide for the issuance of a protective order in such cases. To the extent that State Defendants seek a protective order pursuant to Rule 26(c) of the Federal Rules of Civil Procedure, the Court notes that a motion for a protective order must be accompanied by a certification that the parties have conferred, or attempted to confer, to try to resolve the dispute without court action. See Fed. R. Civ. P. 26(c); see also Local Rule LR37.1. The Motion does not contain a meet-and-confer certification. Federal Rule of Civil Procedure 26(b)(1) specifically provides: "[p]arties may obtain discovery regarding any matter, not privileged, that is relevant to the claim or defense of any party . . . . [or] reasonably calculated to lead to the discovery of admissible evidence." Fed. R. Civ. P. 26(b)(1). Here, Plaintiff has alleged that Defendant Michael Gribbin ("Gribbin") assaulted him, and that the State negligently hired, trained, and/or supervised him. [Mem. in Supp. of Motion at 2]. At issue is Plaintiff's subpoena served on the Honolulu Police Department ("HPD"), which demands production of reports "related to Michael Gribbin, including but not limited to an incident involving Michael Alvarez . . . ." [Ex. A to Motion.] The Court is inclined to find that HPD's reports are relevant to Plaintiff's claims in this action and are thus discoverable. State Defendants have raised claims of Gribbin's right to privacy under the Freedom of Information Act ("FOIA"). The FOIA describes the federal governmental agencies' requirements for making information available to the public. See 5 U.S.C. 552(a). As the term "agency" refers to any "authority of the Government of the United States, whether or not it is within or subject to review by another agency," (with certain exceptions inapplicable here), the Court is inclined to find that the FOIA does not apply to records generated by and in the custody of HPD, which is not a federal agency. See 5 U.S.C. 551(1). Even assuming that the FOIA is applicable here, the section that State Defendants urge to the Court to follow here does not apply to "records or information compiled for law enforcement purposes, but only to the extent that the production of such law enforcement records or information . . . (C) could reasonably be expected to constitute an unwarranted invasion of personal privacy[.]" 5 U.S.C. 552(b)(7). Lastly, under Rule 26(c), a court may, upon good cause shown, issue a protective order "to protect a party or person from annoyance, embarrassment, oppression, or undue burden or expense . . . ." Fed. R. Civ. P. 26(c). The Court is inclined to find that State Defendants have not articulated specific facts and/or harm sufficient for this Court to make a finding that good cause has been shown for a protective order to issue. The parties should appear at the July 5, 2005 hearing prepared to discuss these issues and/or to direct the Court to controlling case law that either supports or contradicts this matter. The Court notes, this inclination is intended only to help the parties prepare for oral argument and is not the Court's final decision in the matter. Rather, the parties are encouraged to raise relevant case law and/or facts to show the Court why its inclination is mistaken or correct.
