EO : Plaintiffs Trustees of the PAMCAH-UA Local 675 Trust Funds ("Plaintiffs") requested that the clerk enter default judgment pursuant to Federal Rule of Civil Procedure 55(b)(1), which states that the clerk may enter default judgment when a plaintiff's claim "is for a sum certain or for a sum which can by computation be made certain[.]" Having reviewed the documents submitted by Plaintiffs, this court finds that Plaintiffs' claim is not for a certain sum or for a sum that can be computed with certainty. Plaintiffs are therefore directed to re-file their request for entry of default judgment as a motion to the court pursuant to Rule 55(b)(2). By way of guidance, Plaintiffs are instructed to clarify the provision in their proposed judgment that the judgment shall be "without prejudice to the Trust Funds to seek additional damages from defendant arising from unreported and/or unaudited hours worked by defendant's employees[.]" Plaintiffs are also instructed to insure that the motion is consistent with the requirements of Local Rule 54.2, with particular attention to subsection (f)4., describing the requirements for an affidavit justifying taxation of copying costs, and subsection (f)5., prohibiting the taxation of electronic and computer research costs.
