The Information was publicly read by the Court. Advised of rights to be indicted by the Grand Jury. Waiver of Indictment signed and filed. Memorandum of Plea Agreement filed, acceptance deferred until after review of the presentence report. Defendant advised of her rights, including her right to trial by jury, etc. Government stated the essential elements of the crime involved. Government summarized its evidence against the defendant. Guilty Plea to the Information. Court accepts the guilty plea and the defendant is adjudged guilty. Referred for presentence investigation and report, and sentencing is set for 12/12/05 @ 1:30 p.m. SOM. Defendant to be released on an unsecured bond in the amount of: $25,000. CONDITIONS: (7b) Comply with pretrial services supervision, and abide by all conditions of release as directed by Pretrial Services. (7g2) Do not apply for/obtain a passport. (7h3) Travel is restricted to: Districts of Colorado, Utah, Nevada and Hawaii for court purposes. 2005-12-12 11 0 Sentencing Minute Entry:Sentencing to the Information -Defendant Malva Ideue present.Discussion held re: issue of restitution.Parties reserve final determination of restitution for a later hearing.Defendant informed the Court that she will appear by telephone at that hearing.Allocution by the Defendant. ADJUDGED:Imprisonment: 8 Months. Supervised Release: 5 Years.Special Assessment: $100.00.CONDITIONS:That the defendant shall abide by the standard conditions of supervision. That the defendant not commit any crimes, federal, state, or local (mandatory condition). That the defendant not possess illegal controlled substances (mandatory condition) That the defendant shall cooperate in the collection of DNA as directed by the probation officer. That the defendant shall refrain from any unlawful use of a controlled substance. The defendant shall submit to one drug test within 15 days of commencement of supervision and at least two drug tests thereafter. Since the defendant does not have a recent history of substance abuse and the offense is not drug related, is recommended that the Court waive the mandatory drug test condition. That the defendant shall not possess a firearm, ammunition, destructive device, or any other dangerous weapon. That the defendant execute all financial disclosure forms, and provide the Probation Office and the Financial Litigation Unit of the U.S. Attorney's Office access to any requested financial information to include submitting to periodic debtor's examinations as directed by the Probation Office. That the defendant serve 4 months of home detention with electronic monitoring as arranged by the Probation Office. During this time, the defendant shall remain at her place of residence during non-working hours and shall not leave her residence without the approval of the Probation Office. The defendant shall wear an electronic monitoring device and follow electronic monitoring procedures pursuant to the Participant's Agreement and shall earn leave as determined by the Probation Office. The defendant also will be responsible for the payment of the electronic monitoring costs as directed by the Probation Office.JUDICIAL RECOMMENDATIONS: 1) Dublin; 2) Any facility in the Utah area.Mittimus is stayed until 1/20/06.Defendant to self surrender @ 10:00 a.m. 1/20/06 at the facility designated by the BOP.The time is the time at the facility.Defendant to remain out on bail with the same conditions to apply.
