EP: MINUTES: Sentencing sa to Counts 27 and 28 of the Indictment - Deft Present not in custody; Court accepts the Plea Agreement; The court adopts the factual findings and guideline application in the presentence report; Deft addresses the court; Motion for Downward Departure - denied; Sentencing as to Counts 27 and 28; No Imprisonment; Probation-5 Years as to each of Counts 27 and 28, to run concurrently. Special Conditions of Probation- l. That the defendant not commit any crimes, federal, state, or local. 2. That the defendant not possess illegal controlled substances. 3. the defendant shall refrain from any unlawful use of a controlled substance. The defendant shall submit to one test within 15 days of placement on probation and at least two drug tests thereafter, as directed by the Probation Office. 4. That the defendant participate in a substance abuse program, which may include drug testing at the discretion and direction of the Probation Office. 5. That the defendant is prohibited from possessing a firearm as defined in 18 U.S.C. 921. 6. That the defendant serve 6 months of home detention with electronic monitoring as arranged by the Probation Office. During this time, the defendant shall remain at herplace of residence during non working hours and shall not leave her residence without the approval of the Probation Office. The defendant shall wear an electronic monitoring device and follow electronic monitoring procedures pursuant to the Participant's Agreement and shall earn leave as determined by the Probation Office. The defendant also will be responsible for the payment of the electronic monitoring costs as directed by the Probation Office. 7. That restitution of $18,760 is due immediately to the U.S. Social Security Administration, and is payable jointly and severally with codefendant Bernadette Lagua, with any remaining balance paid during the period of probation on an installment basis according to the collection policy of the Probation Office but at a rate of not less than 10 percent of her monthly gross income. 8. That the defendant provide the Probation Office and the Financial Litigation Unit of the U.S. Attorney's Office access to any requested financial information to include submitting to periodic debtor's examinations as directed by the Probation Office.
