2002-06-21 36 0 Minutes - Miscellaneous EO: MINUTES This matter came on for hearing on June 14, 2002 regarding Defendant Manuel Lopes' ("Defendant") motion for discovery of search warrant affidavits, specifically the April 16, 2002 search warrant obtained by Agent Michael Rothermund ("the Rothermund Affidavit") and the April 25, 2002 search warrant obtained by Agent James Yuen ("the Yuen Affidavit"). After oral argument was held, the Court ruled it would conduct an in camera review of both search warrants, and permitted the parties to submit additional briefing. The United States of America ("Government") filed its Memorandum in Support of Non-Disclosure of "Yuen" Search Warrant Affidavit on June 18, 2002. No additional briefing was received from Defendant. The Government concedes that the Court should order disclosure of the Rothermund Affidavit but argues that there is no basis upon which to order the disclosure of the Yuen Affidavit as the latter affidavit contains "no information or evidence which exculpates [Defendant] ... and ... is not otherwise subject to disclosure under Rule 16 or other legal authority." (Government's Mem., at 2.) Thus, the Court limits its in camera review to the Yuen Affidavit. If the Government has exculpatory evidence, it must be disclosed to the defense. See, U.S. v. Bryan, 868 F.2d 1032, 1034(9th Cir. 1989), cert. denied, 493 U.S. 858 (1989)(citing Brady v. Maryland, 373 U.S. 83, 83 S.Ct. 1194 (1963)). Further, impeachment evidence, as well as exculpatory evidence, falls within the Brady rule. See, United States v. Bagley, 473 U.S. 667, 677, 105 S.Ct. 3375, 3381(1985)("This Court has rejected any such distinction between impeachment evidence and exculpatory evidence."). In its in camera review, the Court finds that the Yuen Affidavit contains neither impeachment nor exculpatory evidence and, therefore, is not Brady material that must be disclosed to the defense. Defendant's motion is therefore DENIED as to the Yuen Affidavit. The Government is instructed to retrieve the Rothermund and Yuen Affidavits, and to produce the Rothermund Affidavit to Defendant by no later than June 24, 2002, 4:00 p.m. IT IS SO ORDERED. cc: all counsel granting motion for discovery [31-1] by Mag Judge Kobayashi (gs)

Defendant Lopes sought the affidavits of the search warrants that were executed on the residence of the Defendant on April 16, 2002 and April 25, 2002. Defendant's MOTION FOR DISCOVERY was assigned the magistrate judge. The magistrate judge conducted an in camera review of both search warrants. The Government conceded that the April 16, 2002 search warrant affidavit should be disclosed to Defendant Lopes, but argued that the April 25, 2002 search warrant affidavit by Agent James Yuen should remain sealed. On June 21, 2002, the magistrate judge denied Defendant's MOTION FOR DISCOVERY as to the April 25, 2002 search warrant affidavit by Agent Yuen. The magistrate judge found the April 25, 2002 affidavit contained neither impeachment or exculpatory evidence which was required to be disclosed to the defense.On July 1, 2002, Defendant Lopes appealed the magistrate judge's ruling. Defendant Lopes argued the April 25, 2002 affidavit by Agent Yuen contains exculpatory evidence due to the fact the information that was relied on by the Government proved to be false as no evidence was seized during the second search on April 26, 2002. On July 5, 2002, the Government filed the Government's Response to Defendant Lopes' Appeal of Magistrate Judge's Order Denying Disclosure After In Camera Review. The Court has reviewed all the filings by the Government and Defendant Lopes, the magistrate judge's order, and the April 16, 2002 and April 25, 2002 search warrant affidavits.
