EP: MINUTES: Sentencing as to Count 1 of the Indictment; Defendant's Motion for Downward Departure - Defendant Darryl Yonezawa present. The Memorandum of Plea Agreement has been accepted. Paula Yonezawa addressed the Court. Allocution by the defendant. Defendant's Motion for Downward Departure - Granted. sentencing hearing held on 12/30/02 , sentencing Darryl Yonezawa (1) count(s) 1. ADJUDGED: Imprisonment: 6 Months. Supervised Release: 3 Years. CONDITIONS: That the defendant shall abide by the standard conditions of supervision. That the defendant not commit any crimes, federal, state, or local (mandatory condition). That the defendant not possess illegal controlled substances (mandatory condition) That the defendant shall refrain from any unlawful use of a controlled substance. The defendant shall submit to one drug test within 15 days of release imprisonment and at least two drug tests thereafter, as directed by the Probation Office (mandatory condition). mandatory condition is WAIVED. That the defendant is prohibited from possessing a firearm as defined in 18 921. That the defendant serve 4 months of home detention with electronic monitoring as arranged by the Probation Office. During this time, the defendant shall remain at his place of residence except for work and church functions and shall not leave his residence without the approval of the Probation Office. The defendant shall wear an electronic monitoring device and follow electronic monitoring procedures pursuant to the Participant's Agreement and earn leave as determined by the Probation Office. The defendant also will be responsible for the payment of the electronic monitoring costs as directed by the Probation Office. That the fine of $10,000.00 is due immediately and any remaining balance upon release from confinement be paid during the period of supervision on an installment basis according to the collection policy of the Probation Office but at a rate of not less than 10 percent of his monthly gross income. Interest, if applicable, is waived while the defendant is serving his term of imprisonment and shall commence to accrue on any remaining balance upon his on supervision. That the defendant provide the Probation Office and the Financial Litigation Unit of the U.S. Attorney's Office access to any requested financial information to include submitting to periodic debtor's examinations as directed by the Probation Office. That the defendant shall submit his person, residence, place of employment, vehicle, computer, computer disks, and other electronic storage media to a search conducted by the U.S. Probation Office at a reasonable time and in a reasonable manner, based upon reasonable suspicion of contraband or evidence of a violation of a condition of supervision. The defendant shall also submit to periodic unannounced examinations of his computer and computer accessories as well as provide access to his internet service provider account records, as directed by the Probation Office. Failure to submit to a search may be grounds for The defendant shall warn any other resident that the premises may be subject to search pursuant to this condition. >That the defendant is prohibited from or accessing any computer or computer network that can, or has had, access to the Internet, and shall not frequent places where the Internet is available for public use without the prior approval of the Probation Office. >That the defendant is prohibited from possessing and accessing any computer hardware and software or any other electronic device, including WebTV, that facilitates access to electronic mail (e-mail), web browsers, and Internet services without the prior approval of the Probation The defendant shall participate in sex offender assessment and treatment and abide by the policies and procedures of the program, which may include the plethysmograph, polygraph, and other types of testing, as approved by the Probation Office. The defendant shall not view, purchase, possess or distribute any sexually explicit material depicting sexually explicit conduct as defined in 18 U.S.C. Section 2256(2), unless approved for treatment purposes, or frequent any place where such material or entertainment is available. The defendant may change his residence only with the advance approval of the Probation Office. >That the defendant shall cooperate in the collection of DNA as directed by the probation officer. That the defendant register with the state sex offender registration agency in any state where the defendant resides, is employed, carries on a vocation, or is a student, as directed by the Office.
