( 04-8007) The district court certified a class in this employment-discrimination litigation, and the employer has filed a petition for interlocutory review under Fed. R. Civ. P. 23(f). IT IS ORDERED that the petition is DENIED as outside the scope of that rule. The employer does not contest the district judge's application of the Rule 23 criteria for certifying class actions. See petition at 6 n.3: "In this appeal, Petitioner is not challenging the district court's Rule 23 analysis". Instead the employer contends that the representative plaintiff did not file a charge of discrimination with the EEOC and cannot take advantage of a charge filed by another employee. See Horton v. Jackson County, 343 F.3d 897 (7th Cir. 2003). Whether the representative plaintiff has a good claim on the merits, or has satisfied procedural conditions (such as the statute of limitations or a timely charge of discrimination) is subject for review on appeal from a final decision. That the suit is a class action does not permit interlocutory review of substantive or procedural matters outside of Rule 23. See McKowan Lowe & Co. v. Jasmine Ltd., 295 F.3d 380, 390 (3d Cir. 2002).
