2012-05-31 24 0 MINUTE entry before Honorable Sharon Johnson Coleman: Defendant seeks dismissal of plaintiff's complaint for lack of standing, asserting that plaintiff's claims under the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act fail to allege actual injury sufficient to invoke this court's Article III jurisdiction. Defendant concedes that precedent in this jurisdiction allows plaintiffs under these acts to seek statutory damages without proof of actual damage. However, defendant argues that a similar issue is under review by the Supreme Court in First American Financial Corp. v. Edwards, cert. granted, 131 S. Ct. 3022 (June 20, 2011). The court acknowledges that the issues to be determined by the Supreme Court could affect the viability of plaintiff's complaint here. However, no ruling has yet been issued, and the court declines to dismiss the complaint in anticipation of the Supreme Court's decision. The court also rejects defendant's alternative arguments that the complaint insufficiently alleges automatically dialed calls to his cellular phone or that it was required to allege that he incurred charges as a result of these calls.
