2014-09-18 19 0 EXECUTIVE COMMITTEE ORDER: Pursuant to the Executive Committee Orders of December 13, 2013, January 10, 2014, and February 28, 2014, for reasons of judicial efficiency, coordinated pretrial proceedings in cases identified as "Division 3 Cases" were assigned to the Honorable Robert W. Gettleman pursuant to IOP 13(e) and Magistrate Judge Jeffrey Cole. As additional Division 3 Cases were identified by Prisoner Correspondence, those cases were also assigned to Judges Gettleman and Cole for coordinated pretrial proceedings. It appears that the above referenced Division 3 Cases, along with a large number of other cases alleging similar overall unconstitutional conditions of confinement at Cook County Jail (the "Jail"), primarily concerning lack of heat, pests, plumbing issues, and environmental toxins such as asbestos, mold, and mildew, have been filed pro se by current or former detainees at the Jail. Given these common allegations, the cases are interrelated with each other, and they are also related to certain of the matters at issue in United States of America v. Cook County, Illinois, et al., Case No. 10 C 2946, being presided over by the Honorable Virginia Kendall in connection with the enforcement and monitoring of a consent decree entered in that case. Judge Kendall has volunteered to handle all such cases for coordinated pretrial proceedings, with the goal of identifying common issues that can be managed on a coordinated basis. It is hereby ordered that the cases appearing on Appendix A hereto are reassigned for coordinated pretrial proceedings pursuant to IOP 13(e) to Judge Kendall, and Magistrate Judge Cole is designated as the magistrate judge for those cases. This Order shall apply only to cases filed after the filing date of Case No. 12 C 9902, and it shall apply only to cases in which the complaint is based on overall unconstitutional conditions of confinement at the Jail, such as lack of heat, pests, plumbing issues, and environmental toxins such as asbestos, mold, and mildew. A copy of this order is to be entered on the docket in each such case. The Executive Committee contemplates that groups of these cases may be reassigned for coordinated pretrial proceedings to Judge Gettleman, Judge Robert Dow and/or Judge Sara Ellis, who have volunteered to handle coordinated pretrial proceedings at the request of Judge Kendall, Because additional cases may be identified that should be added to these coordinated pretrial proceedings, it is further ordered that, where a case is so identified by Prisoner Correspondence, the Clerk is directed to add that case to the coordinated pretrial proceeding before Judge Kendall, and to designate Magistrate Judge Cole in the case.
