ORDER granting in part and denying in part 30 Plaintiff's Motion for Extension of Time: This case currently is set for jury trial October 19, 2009, with a final pretrial conference scheduled September 25, 2009, a dispositive motion deadline of June 15, 2009, and a discovery deadline of June 1, 2009 (see Docs. 5, 9). Primarily due to Plaintiff's surgeries (and the expectation that he will not be released to full duty until July 2009), Plaintiff's counsel asks the Court to revise the applicable dates and deadlines herein. Some of those deadlines are the province of Magistrate Judge Frazier. The undersigned District Judge GRANTS and DENIES the motion only as to the deadlines for which he bears responsibility. The Court DENIES the motion as to continuing the trial or final pretrial conference. Those dates are firm and shall remain as is. The Court GRANTS the motion only by EXTENDING the dispositive motion deadline from June 15, 2009 to July 15, 2009. Judge Frazier will rule on the requested continuance of the other deadlines (including expert disclosure deadlines, deposition deadlines, etc.). If the trial and the discovery schedule based thereon are unworkable, the parties remain free to consent to trial before Magistrate Judge Frazier and request a new Scheduling and Discovery Order.
