P. 12(b)(6) for failing to state a claim upon which relief may be granted is ALLOWED.Plaintiff Lisa Ricchio's Complaint describes a harrowing experience. Ricchio alleges that in 2011, defendant Clark McLean lured her from Maine to Massachusetts under false pretenses, and thereafter held her against her will at the Shangri-La Motel in Seekonk, Massachusetts for several days. During her captivity, Clark physically, sexually, mentally, and verbally abused her. Specifically, Ricchio alleges that Clark repeatedly raped her, confiscated her car, cell phone, and drivers license, starved her and force-fed her drugs to confuse and disorient her, stole money from her and forced her to steal from stores. Ricchio also alleges that Clark's ultimate intent was to force her into prostitution. According to the Complaint, Clark was convicted in 2014 of four counts of Indecent Assault and Battery relating to this incident, and sentenced to two years in a correctional facility. Ricchio brings this action under the civil remedy provision of the Trafficking Victims Protection Reauthorization Act (TVPRA), 18 U.S.C. s 1595. In addition to naming Clark as a defendant, Ricchio also seeks to recover from Bijal (the corporate entity of the Shangri-La Motel), and the Patels (the motel managers). Ricchio maintains that the motel and its management knowingly benefitted from McLeans alleged abuse of her, and conspired with McLean to benefit from her abuse.To survive a motion to dismiss on Rule 12(b)(6) grounds, a complaint must allege facts that, when assumed true, state a plausible claim. See Bell Atl. Corp. v. Twombly, 550 U.S. 544 (2007); Ashcroft v. Iqbal, 556 U.S. 662 (2009). 18 U.S.C. ยง 1595 permits victims of trafficking to recover from "whoever knowingly benefits, financially or by receiving anything of value from participation in a venture which that person knew or should have known has engaged in an act [of trafficking]." Crucially, the Complaint does not allege facts that would permit a plausible inference that the motel and its managers were "in a venture" with Clark and derived benefit from the trafficking of Ricchio. With respect the motel management, Ricchio alleges that they knew Clark and were friendly with him, that Ms. Patel refused to help her despite her pleas, that they should have known of her abuse from observations of her physical condition, and that Mr. Patel at one point high-fived Clark and alluded to some joint scheme to make money. The most that can be plausibly concluded from these facts is that hotel management may have turned a blind eye to Clark's activities and Ricchio's suffering. They do not, however, support the inference that the motel managers were in a trafficking venture with Clark with respect to Ricchio. (The court takes no position as to whether facts alleged may support a claim against the motel and its management for the breach of a common-law duty arising out of the landlord-tenant relationship. Plaintiff's motion for reconsideration of the court's dismissal of her Complaint against Bijal, Inc., Ashvinkumar Patel, and Sima Patel bypasses the fundamental issue - no fact is plausibly pled that would establish that plaintiff was in fact trafficked or that any act of commercial sex or forced labor as contemplated by the TVPRA occurred while she was confined at the Shangri-La Motel. See 18 U.S.C. ss 1590, 1591. At most, the Complaint suggests that defendant McLean had a contingent intent to force plaintiff into prostitution (there is no plausible inference that the Patels shared that intent). However, the TVPRA does not abolish the law of attempt. Even if the Complaint is meant to plead attempted trafficking (see Mem. at 8), to constitute an attempt a defendant's acts must go beyond mere preparation or contemplation. While the TVPRA punishes those who knowingly (or recklessly) harbor a trafficking victim, plaintiff was not a trafficking victim as defined by the Act. She was the hostage of an alleged rapist who according to the Complaint exercised domination over her for his own perverted pleasure, and not because she was earning illicit income for his benefit. (The TVPRA cases plaintiff cites in her memorandum, with perhaps one district court exception, involve actual acts of prostitution, commercial sex, and forced immigrant labor.)While conspiracy does not require the success of the conspirators' criminal objective, there must be proof of an agreement and plausible allegations that the defendants (here Mr. and Mrs. Patel) joined the agreement intending to see it succeed in its criminal purpose. The most that might be said is that the Patels conspired with McLean to permit him to perpetuate his abuse of plaintiff. Nothing is pled that would plausibly suggest that they had agreed to join a human trafficking venture. (The hearsay statement attributed to Mr. Patel about "getting this thing going again" is meaningless without any factual explanation of the "thing" that preceded the alleged remark.) While the court understands plaintiff's indignation at the Patels' alleged behavior, the TVPRA is not the appropriate vehicle by which to bring them to heel. (RGS, int2) (Entered: 03/08/2016)
