Synthon has infringed claim 1 of the '723 patent by filing its NDA 21-299. Synthon, its officers, agents, servants, employees, and all others holding by, through or under Synthon and all others in active concert or participation or privity with Synthon or controlled by Synthon are enjoined from infringing SB's US Patent 4,721,723 and from commercially making, using, selling, offering for sale, or importing, directly, or indirectly, the paroxetine methanesulfonate drug product described in Synthon's NDA 21-299 until 12/29/06 the date of expiration of the '723 patent, except as otherwise expressly provided for in the License Agreement. All counterclaims asserted by Synthon with regard to the '723 patent are dismissed with prejudice. All claims asserted by SB and all counterclaims asserted by Synthon with regard to US Patents 6,063,927 and 6,113,944 are dismissed without prejudice pursuant to FRCvP 41(a)(2). All protective orders presently in effect shall remain in effect unless modified upon motion of the parties by this Court; and this Court will retain jurisdiction over this matter for the purpose of resolving any disputes that may arise under the Settlement Agreement and License Agreement referred to above.
