2012-06-22 | 15 | 0 | REPORT AND RECOMMENDATION: Plaintiff Paul Redfurn commenced this action pro se on September 13, 2011, alleging that defendant police officers stopped him in front of 42 Christopher Avenue, Brooklyn, New York, on August 22, 2011 and subjected him to an illegal search. On September 21, 2011, I granted plaintiff's motion to proceed in forma pauperis. Since that time, plaintiff has neither contacted the Court to pursue his lawsuit nor provided information to enable the Court to contact him. As he has shown no interest in proceeding with this litigation for over nine months, I am constrained to recommend that this complaint be dismissed for failure to prosecute. Objections to this Report and Recommendation must be filed within fourteen (14) days, with courtesy copies to Judge Cogan and to my chambers, in order to preserve appellate review. See 28 U.S.C. § 636(b)(1). In addition, defense counsel is directed to serve a copy of this Report and Recommendation on plaintiff. Ordered by Magistrate Judge Robert M. Levy on 6/22/2012.
