MEMORANDUM-DECISION AND ORDER adopting Report and Recommendations re 5 Report and Recommendations: The Court hereby ORDERS that Magistrate Judge Baxter's August 7, 2012 Order and Report-Recommendation is ADOPTED in its entirety for the reason s stated therein; and the Court further ORDERS that Plaintiff's application to proceed in forma pauperis is DENIED; and theCourt further ORDERS that Plaintiff's complaint is DISMISSED with prejudice pursuant to 28 U.S.C. ยง 1915(e)(2)(B )(i)-(ii); and the Court further ORDERS that the Clerk of the Court shall enter judgment in Defendants' favor and closethis case; and the Court further ORDERS that the Clerk of the Court shall serve Plaintiff with a copy of this Memorandum-Decision and Order in accordance with Local Rules.
