Steuben, its officers, agents, directors,affiliates,consultants,attorneys,servants,associa t es,members,employees and successors in interest and all persons in active concert or participation with them who recieve actual notice of this injunctuion are permanently restrained and enjoined from infringing and /or contributing to the infringment of the claims asserted in the 549 and 699 patents by making, using, selling, or offering for sale, or importing into the territory of the US, lowfat and/or no-fat ready to-eat pudding products. All other claims are dismissed without prejudice. Steuben shall not be required to pay any damages to Kraft as a result of any activity of Stuben prior to the date of this Order and Judgment relating to the subject matter of this action. Each party shall bear their own costs and attorney's fees. The parties hereto waive all right to appeal from or obtain review of this Consent Judgment and Order. So Ordered.
