ORDER DIRECTING CY PRES DISTRIBUTION OF RESIDUAL SETTLEMENT FUND granting (388) Motion to Authorize in case 7:00-md-01368-CS. Plaintiffs' motion for an order directing a cy pres distribution of the residual Net Settlement Fund balance is GRANTED. The Settlement Administrator shall pay the entire balance of the Settlement Fund, to Habitat for Humanity International. Esades, dated 6/14/2011, re: Counsel writes: Our firm represents the plaintiff class in an antitrust action titled In re High Pressure Laminates Antitrust Litigation, which alleged that manufacturers of certain laminated building products fixed their prices. A settlement was reached by the parties and a distribution of th proceeds was made to the class members, but $41,644.79 was not claimed. We asked the court to award the residual funds cypres to an appropriate charitable organization. On May 17, 2011, the presiding judge, Honorable Cathy Seibel of the United States District Court for the Southern District of New York, ordered that all unclaimed funds remaining in the settlement fund be paid to Habitat for Humanity International.
