2010-03-10 13 0 STIPULATION AND ORDER: IT IS HEREBY STIPULATED AND AGREED by and between the undersigned attorneys as follows: 1. The payment of attorneys' fees, costs and disbursements by the State defendants to attorneys for plaintiffs, Raff & Becker, LLP, 470 Park Avenue, 3rd Floor North, New York, NY 10016 shall be $410,000 for motion practice concerning the Unemployment Insurance Appeal Board's ("Board") 2004 Amelioration Plan as well as motions and cross motions filed in 2006. 2. Specially, plaintiffs have sought fees and costs for the following motions: (1) Plaintiffs' opposition to the Board's 2004 proposed Amelioration Plan; (2) The Board's motion for Reconsideration of the Court's objection of the 2004 proposed Amelioration Plan and for an order modifying the Consent Decree to terminate monitoring of compliance by plaintiffs' counsel; (3) Plaintiffs' cross-motion to dismiss and for contempt, enforcement and further relief; (4) Plaintiffs' motion for enforcement of Checklist Item 24 and the Board's cross-motion for enforcement of the same item; and (5) Plaintiffs' motion to compel compliance with the Consent Decree. The Court's decision on Motion #1 is found at Barcia v. Sitkin, 2005 U.S. Dist. LEXIS 23815 (S.D.N.Y. Oct. 17, 2005); the Court's decision on the remaining motions is found at Barcia v. Sitkin, 2007 U.S. District Court, LEXIS 7419 (S.D.N.Y. Jan. 25, 2007). 3. Payment of the sum due under paragraph 1 is conditioned on the approvals of all necessary state officials as required by Public Officers Law section 17. 4. In the event that the payment of the sum described in paragraph 1 of this Stipulation is not made by February 15, 2010, interest on the sum described in paragraph 1 shall beg in to run on February 16, 2010 at a statutory rate pursuant to 28 U.S.C. ยง 1961. The agreed upon Amelioration Plan is annexed hereto as an appendix and its terms and provisions are incorporated herein as part of this Stipulation and Order. 2. In the event that the parties are unable to resolve disputes regarding the implementation or interpretation any part of the annexed Amelioration Plan, including, but not limited to: changes, additions or modifications to the Decree's checklists; data collection, analysis and reporting; establishing performance standards, goals, and benchmarks; content and methodology of training; or whether defendants have adequate resources to implement Amelioration Plan provisions that are contingent upon funding or staff resources, the parties shall comply with the following procedures: (a) the parties are to first comply with paragraph 53 of the Consent Decree by meeting in an effort to informally resolve their differences; (b) if informal discussions do not result in a resolution, the parties shall mediate their dispute pursuant to paragraph 54 of the Consent Decree and in accordance with the terms of the Mediation Stipulation and Order "So Ordered" on July 12, 2001; and (c) if mediation does not serve to resolve the dispute, the parties have the right, pursuant to paragraph 69 of the Consent Decree to apply to the court for a ruling on the dispute. The parties expressly agree that, in resolving the dispute, the court should consider the purposes and intent of the Amelioration Plan.
