2008-06-03 5 0 Order Dismissing Complaint (I.F.P.) ORDER OF DISMISSAL, I grant petitioner's request to proceed in forma pauperis, but dismiss the petition for the following reasons. Petitioner's request for counsel is also denied. Accordingly, petitioner's application for a writ of habeas corpus pursuant to 28 U.S.C. 2254 is dismissed for failure to fully exhaust his state court remedies. 28 U.S.C. 1915 (e)(2). Petitioner may file a new petition challenging his custody on constitutional grounds once all available state remedies have been exhausted. Petitioner's request for counsel is denied. As the petition makes no substantial showing of a denial of constitutional right, a certificate of appealability will not be issue. 28 U.S.C. 2253.
