2010-07-13	18	0		ORDER: Defendant having failed to appear before the Court on July 12, 2010, IT IS HEREBY ORDERED that Plaintiffs shall have default with respect to liability against Defendant. Nevertheless, the Court will ask Plaintiffs to clarify their entitlement to damages prior to entering their proposed default judgment. Specifically, it appears that the total principal sum sought ($1,347,915.14) includes interest at the contractual rate of 8% from the time of the promissory note to the date of this Order, and that the proposed default judgment seeks an additional 9% interest on that sum from the date of the filing of the action to the date of this Order. Pursuant to New York law, however, "[i]f the contract provides a rate at which interest is to be calculated, then the contractual rate, rather than the statutory rate of nine percent per year... governs." Nuero Commc'ns, Inc. v. Telron Commc 'ns USA, Inc., No. 00 Civ. 9167 (RMB) (FM), 2002 WL 31778796, at *3 (S.D.N. Y. 2002) (R&R). In any event, there does not appear to be authority for simultaneously awarding both contractual and statutory interest. Plaintiffs are accordingly ORDERED to either (1) submit a letter to the Court clarifying its entitlement to the proposed judgment, or (2) submit a revised proposed judgment to the Orders and Judgments Clerk reflecting this Order, by July 23, 2010.
