2011-12-13 23 0 ORDER: On September 15, 2011, the Court issued a preliminary injunction in this action that, among other things, enjoined Defendants from "transferring or removing Plaintiffs property from its current location." The Court is now in receipt of a letter from Plaintiff, dated December 9, 2011, requesting that the Court enter an order directing Schiller & Bodo, a New York art dealer, to return three works of art to Plaintiff. According to Plaintiff, the three works were given to Schiller & Bodo on consignment by Defendants R. Scott Cook and Cook Fine Art. In light of the fact that Schiller & Bodo are not named in the preliminary injunction, and that the preliminary injunction does not require any party to return property to Plaintiff, but merely prohibits Plaintiffs alleged property from being removed from its current location pending resolution of the action, Plaintiffs request is denied. To the extent that Plaintiff seeks a modification of the terms of the preliminary injunction, Plaintiff must demonstrate that he is likely to succeed on the merits, that he is likely to suffer irreparable harm in the absence of preliminary relief, that the balance of equities tips in his favor, and that an injunction is in the public interest. See Winter v. Natural Res. Def. Council, 555 U.S. 7,20 (2008). Plaintiff has not made such a showing with respect to the property allegedly held by Schiller & Bodo. (Signed by Judge Richard J.
