Hood ("Hood") show cause before a motion term of this Court at Courtroom 14A, United States Courthouse, 500 Pearl Street, in the Borough of Manhattan, City of New York, County of New York, State of New York, on June 1, 2012 at 2:00 in the afternoon thereof, or as soon thereafter as counsel may be heard, why an order should not be issued pursuant to Rule 65 of the Federal Rules of Civil Procedure pending resolution of this case: (i) enjoining Defendants Intrepid and Hood from using any of IBG's proprietary and confidential information, including but not limited to, any and all proprietary and confidential information relating to IBG's bid with respect to the 2011 INSCOM Solicitation for Biometric Identity Intelligence Project (Solicitation No. W911 W4-11-R-0004) (the "2011 BI2 Project"); (ii) enjoining Defendant Hood from directly or indirectly attempting to solicit, or soliciting, the Department of the Army, Intelligence and Security Command, the National Ground Intelligence Center or related agencies (the "Government Intelligence Agencies") with respect to any bid, contract or business opportunity for services and/or products the same as, or the functional equivalent to, those included in the 2011 BI2 project for a period though and including June 30, 2013; It is further Ordered that Intrepid and Hood are required to preserve, and on or before 5:30 p.m. on May 30, 2012, to disclose the IBG copies of any and all documents relating to Hood's direct or indirect participation in (a) the preparation of any bid by Intrepid with respect to the 2012 BIP Project, and (b) the bid process for the 2012 BIP Project; and it is further Ordered that security in the amount of $200,000 will be posted by Plaintiff by May 30, 2012 or the plaintiff is not required to provide an undertaking in support of the restraining order; as further set forth in this Order to Show Cause.
