We were unable to resolve this issue with plaintiffs, and accordingly,we moved yesterday to dismiss the complaint for lack of subject matter jurisdiction.In light of our motion, we do not believe this case will remain in this Courtfor very much longer. We respectfully ask that this Court defer our compliance with allof the requirements of the order- including the submissions and the appearance- until ithas adjudicated the motion (and, we expect, granted the motion), lest the parties be forced expend further resources on a matter that appears destined to be short-lived.
