On March 22, 2013, Judge Netbum issued a Reportand Recommendation recommending that this Court decline to exercise jurisdiction over Oraco's Rule 41(g) motion. The prescribed time for objections to Judge Netbum's Report and Recommendation has elapsed and the Court has received none. Following de novo review, the Court adopts Judge Netbum's thorough and well reasoned Report and Recommendation in full for the reasons set forth in that Report. The Court hereby grants thatrequest and adjourns the trial date to March 31, 2014. Jury charges, anyproposed voir dire, and any motions in limine shall be due by March 7, 2014. Responses to any motions shall be due by March 14, 2014. Counsel for Ms. Thomas, Mr. DeVita, has misinterpreted the Court's efforts to accommodate counsel's request for an adjournment of the trial date. Contrary to the statement in Mr. DeVita's December 20, 2013letter, the Court's goal never was "to intervene with Chief Judge Preska to seek[Mr. DeVita's] removal as CJA counsel" in the action pending before her. (Dkt. No. 93.) To the contrary, the Court's efforts were an attempt to accommodate the defense request for an adjournment of this trial that would permit all counsel - prosecution and defense alike - to continueto represent their respective clients at the trial of this action as well as atthe trial of the action pending before Chief Judge Preska. That goal hasnow been accomplished consistent with the Speedy Trial Act. On or before January 3, 2014, Mr. Nelson shall provide the Court with a report as to the status of making the discovery materials electronically searchable by all defendants. As an initial matter, it is somewhat unclear whether Mr. Nelson's letter is directed to the Court or to Assistant U.S. Attorney Edward Imperatore. Although the inside address is the Court's, the salutation is to Mr. Imperatore. Somewhat confusingly, the letter closes by stating that counsel "expect[s] you to advise [counsel] immediately so that the time for disclosure can be resolved by the Court." (Id. at 3.) This certainly suggests the letter is not directed to this Court... Regardless of the identity of the intended recipient, there is no indication on the face of the letter that the parties have attempted to resolve the issues raised in the letter before seeking relief from the Court.
