ENDORSEMENT: The Court is in receipt of Defendant's pre-motion letter regarding its contemplated motion to dismiss for insufficient service of process pursuant to Fed. R. Civ. In its letter, Defendant argues for dismissal based on Plaintiff's service of a woman who is, in fact, not an employee of Defendant. (Id.) However, Plaintiff asserts that three days after Defendant sent its letter, Plaintiff also served both Greg Smith, who is Defendant's Chief Financial Officer, and Defendant's attorney, Neil Moskowitz, whom Plaintiff asserts is Defendant's registered agent, on June 6, 2016. (Doc. Nos. 27, 28.) If true, such methods of service would conform with Fed. R. Civ. P. 4(h)(1), and would be effectuated less than ninety days after the filing of the complaint on May 6, 2016, as required by Fed. R. Civ. P. 4(m). Accordingly, in light of Plaintiff's affidavits of service, which Defendant has not challenged, IT IS HEREBY ORDERED that Defendant's motion to dismiss for insufficient service of process pursuant to Rule 12(b)(5) is deemed made and is denied.
