| 2016-06-08 | 5 | 0 | MEDIATION REFERRAL ORDER FOR PRO SE EMPLOYMENT DISCRIMINATION CASES: that this pro se case is referred for mediation to the Court's Mediation Program. Local Rule 83.9 and the Mediation Program Procedures shall govern the mediation. Unless otherwise ordered, the mediation will have no effect upon any scheduling order issued by this Court, and all parties are obligated to continue to litigate the case. It is FURTHER ORDERED that the Clerk of Court shall attempt to locate pro bono counsel to represent the plaintiff at the mediation. Pro bono counsel will contact the plaintiff directly. The time to assign a mediator under Local Rule 83.9 and the Court's Mediation Program Procedures will be deferred until pro bono counsel has filed a Notice of Limited Appearance of Pro Bono Counsel. Pro bono counsel will represent the plaintiff solely for purposes of the mediation, and that representation will terminate at the conclusion of the mediation process. It is FURTHER ORDERED that any objection by the plaintiff to either the mediation or to the Court's request for pro bono counsel to represent the plaintiff in the mediation must be filed within 14 days of this order. | 2016-06-08 | 6 | 0 | ORDER OF SERVICE: By order dated May 23, 2016, the Court granted pro se Plaintiff's request to proceed without prepayment of fees, that is, in forma pauperis. To allow Plaintiff to effect service on Defendants Fenix Arias; Bronx Community College Association, Inc.; and Donovan Miller through the U.S. Marshals Service, the Clerk of Court is instructed to fill out a U.S. Marshals Service Process Receipt and Return form ("USM-285 form") for each of these defendants. The service address for each defendant is: (1) Fenix Arias, Bronx Community College, 2215 University Avenue, Language Hall Room 27, Bronx, New York 10453; (2) Bronx Community College Association, Inc., 2215 University Avenue, Bronx, new York 10453; and (3) Donovan Miller, Director, Bronx Community College, 2215 University Avenue, Colston Hall Room 810, Bronx, New York 10453. The Clerk of Court is further instructed to issue a summons and deliver to the Marshals Service all of the paperwork necessary for the Marshals Service to effect service upon these defendants. It is Plaintiff's responsibility to ensure that service is made within 90 days of the date the summons is issued and, if necessary, to request an extension of time for service. See Meilleur v. Strong, 682 F.3d 56, 63 (2d Cir. 2012). Plaintiff also must notify the Court in writing if her address changes, and the Court may dismiss the action if she fails to do so.
