2016-09-20 4 0 ORDER TO AMEND: The Clerk of Court is directed to assign this matter to my docket and mail a copy of this order to Plaintiff, noting service on the docket. The Court dismisses without prejudice Plaintiff's claims against the City of New York, Detectives Velez and Mischa, Judges Knoviser and Obus, and ADA Charles Kee as duplicating his pending claims in McBride v. Velez, No. 15-CV-3203. The Court also grants Plaintiff leave to file, within sixty days of the date of this order, an amended petition for a writ of habeas corpus under 28 U.S.C. § 2241. An amended petition for a writ of habeas corpus under 28 U.S.C. § 2241 form is attached to this order. If Plaintiff files an amended petition, it should be labeled with docket number 16-CV-6988 (CM), and submitted to the Court's Pro Se Intake Unit. If Plaintiff fails to file an amended petition, this action will be closed as duplicative of his pending claims in McBride v. Velez, No. 15-CV-3203 (CM). Because Plaintiff has not at this time made a substantial showing of a denial of a constitutional right, a certificate of appealability will not issue. See 28 U.S.C. § 2253. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
