No other party objected to the Report and Recommendation. Having reviewed the Report and Recommendation de novo after considering the Objections and the parties' submissions, see 28 U.S.C. Section 636(b)(1), this Court concurs with the findings and recommendations contained in the Report and Recommendation. Accordingly, Greater Omaha Packing's Objections are DENIED, and the Report and Recommendation is ACCEPTED in its entirety, including the authorities cited and the reasons given therein. IT HEREBY IS ORDERED, that the 93 Report and Recommendation is ACCEPTED. FURTHER, that Fairbank Reconstruction's 71 Motion for Summary Judgment is GRANTED in part and DENIED in part, consistent with the Magistrate Judge's Report and Recommendation, there being no objection thereto. FURTHER, that Greater Omaha Packing's 98 99 Objections are DENIED. FURTHER, that Beef Products's 72 Motion for Summary Judgment is GRANTED for the reasons set forth in the Report and Recommendation. FURTHER, that the 59 Third Party Complaint is DISMISSED, and the Clerk of Court is directed to terminate Beef Products as a party to this action. SO ORDERED. Issued by William M.
