REPORT AND RECOMMENDATIONS - re 2 - Because Hoover has not shown that the Ohio Supreme Court decision in this case is contrary to or an objectively unreasonable application of clearly established Supreme Court precedent, the Petition should be dism issed with prejudice. Three distinguished Justices of the Ohio Supreme Court disagreed with the result in this case, but did not base their decision on any in-point United States Supreme Court precedent.
