ORDER ADOPTING 106 Report and Recommendations of the US Magistrate Judge on the Parties' Motions for Summary Judgment. The Defendants' 85 Motion for Summary Judgment is GRANTED with regard to the claims against Captain Danheim and DENI ED as to the claims against Barry Andrews and Sherman Cooper. The claims against Captain Danheim are DISMISSED and Captain Danheim is dismissed as a party to this lawsuit. Captain Danheim's 75 and 78 motions to Dismiss for Failure to Exhaust Administrative Remedies are DENIED as moot.
