Office of the Secretary, Boston, Jan. 21, 1892. To the Honorable Senate and House of Representatives. The second annual report of the number of assessed polls and the number of registered voters at the close of the state, city and town elections in the year 1891, and the total num- ber of persons who voted at such elections in each city, town and voting precinct in the Commonwealth is hereby sub- mitted, in accordance with the provisions of section 118, chapter 423, acts of 1890. By an act of 1891 (chapter 329, section 4) the secretary of the Commonwealth is required to include in this report a concise statement of other matters relating to elections, with such suggestions thereon as may be deemed advisable. In compliance with this act, I submit the following : — Suggestions from City and Town Officers. Soon after the last state election, a circular letter was sent to the selectmen of towns and the city and town clerks, request- ing them to communicate to this office any suggestions that they might desire to make in the direction of improving the methods and apparatus in use at elections under our present ballot system. Over one hundred replies were received from towns and six from cities. General complaint was made of the defective working of the registers on the ballot- boxes. Investigation shows, however, that the fault was not so much with the registers as with the operators of the boxes, who failed to observe the printed directions which were forwarded to each city and town. Up to the present time it has been impossible to procure ballot-boxes which can be relied upon to register correctly the number of ballots cast, and as the names of voters are required to be checked twice before voting, and as the number of ballots cast must agree with the number of names checked, regardless of the 4 ASSESSED POLLS, ETC. [Jan. number indicated by the ])allot-box register, it would seem advisable not to require registers on ballot-boxes. There was a general expression of approval of the present method of counting and canvassing the votes, and of the blank forms furnished for that purpose. The length of time required to make the "double count," and the popular demand for the earliest practicable announcement of the results of elections, led to the suggestion in many cases that if the doul)le count is to be continued, permission should be granted, under proper restrictions, to count the ballots during the progress of the voting. Several changes in the manner and method of counting and canvassing the votes were suggested, but none on which there is a general agreement ; but there appears to be a gen- eral desire that no additional experiments be tried, except those that will simplify matters, until there is time to become familiar with the present methods. Among others which seem worthy of attention is the sug- gestion that the cards of instructions and specimen ballots be sent separate from the official ballots, and that city and town clerks be required to cause the same to be posted up in the polling places on the day of election prior to the opening of the polls, thus saving much valuable time. A general desire was expressed that the names of candi- dates be printed on the tally- sheets, but it is not deemed practicable, as this would necessitate the preparation, print- inji and sendino; out of these sheets at the same time as the printing and distribution of the ballots, which might result in one or both failing to reach their destination as provided by law. Election Officers. It has been suggested, and it would seem advisable, that, in addition to the qualifications now required by law, kppointivc election officers and tellers should possess the necessary qualifications to perform properly the clerical ser- vices required of them, such qualifications to be determined by a simple examination, and a list of qualified persons kept in the office of each city and town clerk. The provisions of law relative to the appointment of tellers in towns at state elections and at town elections, under chap- 1892.] PUBLIC DOCUMENT — No. 43. 5 ter 380, acts of 1890, should be mtide mandatory. Such appointments are now implied by the provisions of chapter 328, acts of 1891. The compensation of election officers and tellers should be such as will command the services of those best qualitied to serve ; complaint has been made that proper compensation is not always provided. Town Clerks on Registration Boards. Attention has been called to the provisions of law which require town clerks, as members of appointive ])oards of reg- istrars of voters, to be partisans ; it would seem advisable that in such cases the town clerks should cease to be mem- bers, but should continue to be clerks of such boards. Marking Ballots. The provisions of law relative to the arrangement of the names of, and the marking for, candidates for electors of president and vice-president of the United States should be amended so as to require less space on the ballots, and so that one X mark will be counted a vote for a group of tifteen electors. Attention has been called to the finding of marks on ballots which have the appearance of having been made while they were beino; counted, and it has been sus^gested that some peculiar pencil, stamp or punch be furnished for the use of voters in the marking of ballots, so that the voter's choice can be so indicated as to prevent others changing it. Apparatus for Counting. In accordance with the provisions of cha})ter 328, acts of 1891, a number of ditferent kinds of apparatus intended for use in the count and canvass of votes have been examined by the secretary, treasurer and auditor, none of which were deemed to meet the requirements of law. There are several machines to which attention has been called since the last state election, one of which is intended to dispense w^ith the use of ballots, and all of them propose to do the counting and tabulating of the votes as each vote is cast ; and it is suggested that a committee be authorized to inquire into the merits of 6 ASSESSED POLLS, ETC. [Jan.'92. such apparatus as may be presented to them, as the adoption of such apparatus will require amendments to the election laws. Ballot Law Commissioners. The officers authorized to consider and determine objec- tions relating to nominations of candidates for state officers should be authorized to send for persons and papers, and to administer oaths to witnesses who appear before them. Pro- vision should be made for the compensation of the ballot-law commissioners appointed by the governor. Keturns of Voters by Assessors. Article 32 of the amendments to the constitution, ratified at the last state election, nullifies the provision of law rela- tive to the payment of a tax as a prerequisite to the placing or retention of the names of persons on the voting lists. It is suggested, therefore, that among other necessary amend- ments, the assessors be required to ascertain, return and pub- lish street lists of names of legal voters instead of assessed polls, and that the number of such legal voters be returned to and published by the secretary of the Commonwealth. Codification of Election Laws. In addition to the several amendmeiits and additions to the election laws which will necessarily be made, these laws should be re-arranged and consolidated, including the enact- ments of the present year. At the present time, there are many provisions of these laws which are confusing and mis- leading, and it is impossible to understand them without a careful study. For instance, the ballot act, though quoted and referred to as chapter 413, acts of 1889, is chapter 436, acts of 1888, as amended by chapter 413, acts of 1889 ; and certain provisions of chapter 436, acts of 1890, are in amend- ment of the ballot act, but it is not so stated. In the general election act, chapter 423, acts of 1890, there are several provisions which arc in a[)parent conllict with the ballot act, and others which have been amended by implication. Tables of percentages and comparisons are printed on pages 8, 9, 10, 11, 12 and 13. Apparent incongruities in the report may be accounted for, in part, as folio svs : — First, In all the cities and in many of the towns the number of assessed male polls includes aliens and other persons who are not qualified to become registered voters. Second. The number of registered male voters includes many persons w^ho are exempt from taxation and therefore are not included in the number of assessed male polls. Third. The number of registered female voters includes many women not assessed for poll tax, who were registered upon payment of property tax, and therefore are not included in the number of assessed female polls, hence comparisons, in this instance, have not been made. Elections and PollinCx Places, 1891. Town elections, (February, March or April,) 1 polling place in each of the 323 towns. State election, (November 3,) 883 polling places, viz. : — 205 in Boston, 296 in 28 cities, 94 in 35 towns, which are divided into voting precincts, and 1 in each of the 288 towns not divided into precincts. City elections, (December,) 501 polling places in the 28 cities. Town Ballot Act. Chapter 386, acts of 1890, entitled An Act to authorize the Printing and Distributing of Ballots for Town Elections at the Public Expense, has been accepted by 122 towns. 8 ASSESSED POLLS, ETC.
