Forum: feature_films Subject: Films Before 1978 With No Notice or Inadequate Notice - Copyright Lost Permanently

As I am researching some items on copyright I ran across this at USCO. I know the question has come up with some uploads that the upload has a copyright notice but other copies are know not to contain a notice. According to USCO before 1978 if a work was published before 1978 without notice or an inadequate notice the right to secure copyright was lost. Adding a notice or correct notice to copies distributed at a later date does not secure the copyright. Code of Federal Regulations: Section 202.2 (a) General. (2) If before January 1, 1978, publication occurred by distribution of copies or in some other manner, without the statutory notice or with an inadequate notice, as determined by the copyright statute as it existed on the date of first publication, the right to secure copyright was lost. In such cases, copyright cannot be secured by adding the notice to copies distributed at a later date. Remove that semi colon to paste the link in your browser

Good research, but keep in mind that most foreign films that fell into the Public Domain under these rules have had their copyright status restored.

Well, Here's wondering about the Christmas movie.... Kathy O'..... 1958 - Patty McCormack & Dan Dureay She's about 12 or 13 in this and for my opinion did rather well. Transitioning from just malevolent pure evil to pure charm is a great change.... This project was just right for us to come to at least like her.

But acquiring it? In the first place it just doesn't seem to be available from anyone anywhere at any price....
Same thing with Jerry Lewis' 'Rock-A-Bye-Baby. Got that one from Amazon.uk and that product comes from Holland. (don't unnerstan' why that one is so rare)
The long lost episodes of Saturday mornings' Fury are available from Australia. And then there's Disney's 'Song of the South' with the first ever black Oscar winner... but the NCAA just has a coniption whenever anyone mentions anything about that one and just prohibit anyone from seeing the antics of B'rers Rabbit, Fox, an' Bear.

YammeringMagpie.com was my source for Kathy O' but looks like they shut down.

How ya gonna get hold of some of these on the open market - I dunno. I jus' wish some of these folks that hold the legals on some of these wolud some day be a little less stingy with their distribution.

Gu-luk.
