I believe that the Archive can do nothing to remove the "blip.TV" videos (Phantasmagoria theatre), but I am wondering why "Not Of This Earth" has not been removed. The version on here is not the original cinema release, it has a different pre-amble, but a TV print with the copyright notice framed out of the image. The copyright was owned by Allied Artists Pictures until their bankruptcy in 1979 when their entire post-1936 catalogue was transfered by sale to Lorimar. The claims in the reviews that Clarke Films "owned the rights" are misleading. Clark Films is a Florida based film exchange and distributor. They started their business in the mid 60s by securing the lucrative distribution rights to the Allied Artist catalogue, but never owned the copyright. Allied Artists had full rights to transfer this film's copyright to Lorimar and Lorimar had full rights to renew this copyright. Below are attached the full frame off an original cinema release print and the matted frame from the TV print that appears here.

Do they have some sort of arrangement with IA that allows them to post copyrighted movies? Are their uploads here legally or not? My curiosity is based on the fact that their uploads are mostly things I would love to watch. I mean, c'mon...The Return of the Vampire: Lugosi as Dracula (with a different name), a female van Helsing, and a werewolf Renfield! Some of the Phantasmagoria Theater stuff have been here for nearly two years, apparently under copyright, yet IA can do nothing to remove them? Why? Thanks in advance...

I think that the IA's Blip.TV section is just a mirror for the old Blip.TV site. I think the uploads in that section can only be maintained by Blip.TV (a few admins have said that they don't have privs to remove blip.tv stuff.) The current Blip.TV site doesn't allow access to any of this stuff but does let it stay in the archive.

But how come some of this stuff is relatively new? I just looked and there's some stuff that's only been here a few hours, though it's not the same stuff as the files listed at the beginning of this thread. So more copyrighted stuff could come in through there any time.

Also, I notice that a few of the uploads mentioned at the start of this thread have been removed, so some one (in or out of the archive, who knows?) does have a set of administrative keys...there is also what appears to be some very disturbing and illegal content in that section, but I'm not about to click on the links to find out for sure.

I don't know if this makes any difference, but I checked out most of these links and found the resolution to be so poor that the uploader(s) aren't really doing anyone any favors here. I would advise any potential downloaders interested in these films to open up your wallets and cut loose of a couple of bucks and buy legit dvds from whoever puts these films out to get better copies. Watching these crappy files is like like watching a movie through a shower door. I like getting free movies as much as the next guy, but this stuff is copyright as well as being just crap.

seeing as how Shout! Factory claims the DVD version was taken from negatives, I don't see how you can claim it is from theatrical prints at the time.

The extra space above on the TV print appears to be part of the original print used to make the pan and scan. Most likely the person who transferred the negative back in 1956 did not have the frame centered and left off the notice. The negative would definitely not qualify as an original release print.

- The full frame still does not come from the Shout DVD.

- The TV print was matted with thin black bars at the top and bottom of the frame. The notice was obscured by these mattes. Removal of the notice on a print reformatted for television broadcast does not put an otherwise copyright film in the public domain. It doesn't even put that "limited distribution" print into the public domain.

- This film has never had a legitimate public domain video or DVD release - only bootlegs (and the one official DVD). Wide bootleg distribution, does not make a film public domain, even if the bootlegger states that they think it is public domain as part of the foundation for their future legal defence.
