The distiihution of the force is shown by Table I. On 
NoveuiI>€r 30 there were 53 vacancies, viz., (i patrolmen and 
47 reserve men. During the year 8t) officers were appointed 
(inchiding 48 reserve men), 19 discharged (including 3 re- 
serve men), 16 resigned (including C> reserve men), 8 re- 
tired on pension luid 6 died (inchiding one reserve man). 
(See Tables II., III. and V.) 

Capt. Joseph II. Bates was retired Aug. 23, 1800. He 
■was appointed on tiic force April 18, 18(J7 ; promoted ser- 
geant April 28, 1871 ; jiromoted lieutenant Sept. 10, 1877; 
promoted captain June 8, 1880. 

Lieutenant Edward il. Johnson was retired Xov. 29, 
1890. He was appointed on the force ilarch 2, 18G3 ; pro- 
moted sergeant June 1, 1870 ; promoted lieutenant April 3, 
1871. 

Ser«reant Ot^sood AV. Knowles was retired Nov. 29, 1890. 
He was appointed on the force Oct. 10, 1864 ; promoted 
sergeant :March 27, 1878. 

Lieutenant Michael Merrick was promoted to be captain 
Aug. 23, 1890, his stauding on the civil service list being- 
89.45. 

Sergeant Thomas C. Evans and Sergeant Frederick G. 
Hoffman were promoted to be lieutenants, their standing on 
the civil service list being respectively 88.90 and 87.15. 

Patrolman George A. Hall and Herman B. Bodenschatz 
were promoted to be sergeants, their standing on the civil 
service list being respectively 87.36 and 87.27. 

House Watchmen Nathan S. Albee and Timoth}' H. Pea- 
body were retired on pensions June 3, 1890, and Patrolmen 
William C. Jenks and Benjamin F. Farwell were appointed 
to fill the vacancies.

Patrolman Charles Maynes and Reserve Officer Frederick 
L. Benjamin were commended for efficiency and bravery dis- 
played in saving human life at the fire which occurred in this 
city on Nov, 28, 18S0. 

Patrolman Jeremiah O'Brien was commended for meritor- 
ious serrice rendered in rescuing a l)oy four years of age 
from drowning in the M^'stic River on May 2, 1890. 

The average numl>cr of men absent from duty on account 
of sicivnesi was 23 per day, or 2.66 per cent, of the force.

During the year one hundred and thirty-one complaints 
against officcrii were investigated by the Board. The nature 
of complaints and disposition of cases is shown by Table VI. 

Hoi:ies. 

On the 1st of December, 188!>, there were 46 horses in 
the service. During the ^ear 13 were sold and exchanged 
and 2 were purchased. At the present time there are 48 in 
service, as shown by Table VII. 

WOUK OF THE DePARTMEXI. 

The total number of persons arrested was 37,402, against 
40,066 the preceding year. I>eing a decrease of 2,574. The 
percentage of increase or decrease was as follows : —

Five tboosand five hundred and eighty-two persons were 
arrested on warrants, and 31,380 without warrants ; 530 per- 
sons were snmmoned by the court; 33,510 persons were 
held for trial, and 3,982 were released from custody. The 
number of males arrested was 31,966 ; of females, 5,526 ; of

Takin<j the statistics of arrests for the decade ending: 
18S!1, and estimating the average population of the city at 
386,300, the average number of arrests was 31,022; the 
niimljer of arrests in 1890 was therefore t!,470 above the 
average. (See Table X.) 

Of the total number of arrests for the year (37,492), 
only 934 were for violations of the cit}' ordinances ; that is to 
say, one arrest in forty was for snch oflencc, or 2.49 per cent. 

Sixty per cent, of persons taken into custody were 
between the ages of twenty and forty. (See Table XI.) 

The number of persons pimishcd by fines was 25,950, and 
the tines amoimted to $17.'),(J0.').70. 

Sixty-four persons were sent to the State Prison, 670 to 
the House of Correction, 45 to the AVoiiien's Prison, 17G to 
the Keforniatory Prison, 126 to the House of Reformation, 
949 to the House of Industr}', and 106 toother institutions. 
The total years of imprisonment was 1,902^,. The total 
luimber of days' attendance in com t by officers was 31,849, 
and the witness fees earned amounted to $27,160.31.

The value of property taken from prisoners and lodgers 
was$l<l,280.;tl. 

Two hundred and seventeen witnesses were detained at 
station houses, and 0,40.3 peri»was were accommodated with 
lodgings, an increase of 107, C per cent, over last year. 
There was an increase of about 35 per cent, from last year 
in tlic number of insane per^^os taken in charge, a decrease 
of about '26 per cent, in the numl*er of sick and injured per- 
sons assisted, and an iDcrea.-re of about 3.5 per cent, in the 
number of lost children cared for. 

The average amount of property reported stolen in the city 
for the decide ending !?<.'*» was #95,113.08; in 1890 it was 
$75,8(54.13. or $lit,-24>(.y5 les^ than the average. In the 
same period the average amount of property- stolen in and 
out of tiie city whicli wa^ recovere<l by the Boston police 
was $1 15,'.'()0.73 ; the amount recovered in 1890 was

The avenige anxiunt of fines imposed by courts was

The department made thirty-eight raids on gambling 
houses, and seized property to tiie amount of $2,719.27. 
The number of persons arrested on these raids was 1(39. 

In its last annual report the Board called attention to the 
fact that places of this character were carried on under char- 
ters granted by the State, obtained under the pretence that 
they were clubs organized for social and literary purposes. 
An act was passed (chapter 439, Acts of 1890) which was 
intended to prevent this abuse, and will undoubtedly have 
that eflect. But in section 2 of that act, which provides for 
the revocation of charters, in case the incorporators are con- 
victed of certain ofl'ences, the word " hereafter" was inserted 
in the second line, making it apply only to clubs organized 
after the passage of the act. In August last the rooms of 
the Argo Club, which holds a charter, were raided, gambling 
implements seized, and eleven persons arrested. These 
persons pleaded guilty of being present where gaming im- 
plements were found, were each fined ten dollars, and paid 
their tines. The case being reported to the Secretary of 
State, he decided that, the charter having been granted 
prior to the passage of the act, it could not be revoked, so 
that the club continues to enjoy the protection which the 
seal of the Commonwealth aflbrds. The Board therefore

recommends that the act be amended so as to make the 
r«»cond section apply to clubs or organizations incorix)rated 
prior to its passage. 

A form of gambling, commonly known as "playing 
policy," is increasing, and needs some decisive measures to 
^oppress it. It is gambling in its most pernicious form, 
f<*cau»c it is chiefly indulged in b}' those who can least afford 
lf> lose Ihe money which ihey invest in it. Even children 
are induced to play, and the habit of indulging in games of 
<-aancc is formed at an early age, leading to greater vices 
ItTer on. The police force has exhausted every means to 
suppress the evil. The sul)ject has been presented to the 
eijnrts in all its forms, but without success, for the reason 
t£:it the law is insufficient to reach the case. This is also 
the fact in relation to the Louisiana lottery. The possession 
o<ra lottery ticket should be made a penal offence, and prima 
ft<ie evidence of the existence of a lottery ; and the govem- 
jBent sht)uld not l)e required to prove the intent to sell such 
ta:ket, or the fact that a lottery has been or is to be drawn 
in Xew Orleans, Boston or any other place.

the prison reports of G96 discharged convicts, containing the 
full records, descriptions, distinguishing niarlvs, etc., of 395 
convicts wiio were discharged during the \'ear, and whose 
records were considered of suflicient importance to preserve. 
Otiier police departments were furnished with 264 copies of 
these reports.

Four were bodies found in the harbor and adjoining rivers, 
without any marks of identification. One was killed by 
railroad accident and two died suddcnl}' from alcoholism. 

The accidents include 81 deaths by railroad accident, 54 
of which occurred within the city limits, and 27 outside of 
the city, but were brought to our hospitals, where death 
resulted. Of these, 6 deaths were by electric-car accident 
and 9 by horse-car accident.

Licetises. 

The total number of licenses issued of all kinds, except 
for the sale of intoxicating liquor, was 21.579; transferred, 
116 ; cancelled and revoked, 1,218. The ofScers investigated 
137 complaints arising under these licenses, and 34 hearings 
were given by the Board on these complaints. The fees 
collected and paid into the city treasury amounted to 
$35,037.40. (See Table XII.) The department reported 
to the Board of Health on 252 applications for fruit, tish and 
vegetable peddlers' and grease collectors' permits, between 
Dec. 1, 1889, and Sept. 3, 1890. Then the practice of hav- 
ing police officers investigating and reporting on such appli- 
cations was discontinued, at the request of the Board of 
Health. 

Ambulance Sei-vice. 

An additional ambulance was purchased during the year, 
making four in service. One was stationed in Division 11, 
to be used in case of accident to any of the others, and to

respond to calls for ambnlancc service in that iinnaediate 
vicinity. This ambulance rendered good service on the oc- 
casion of the accident on the Old Colony liaiiroad at Quincy, 
August 19. 

The four ambulances are stationed in divisions 1, 4, 7 and 
11. Ambulance \o. 1 made 32.'. runs, and conveyed 283 
persons to the hospitals, 21 home and 11 to other places. 
Ambulance No. 2 made 4f/J runs, and conveyed 411 persons 
to the hospitals, 42 home and Ui to other places. Am- 
bulance Xo. 3 made 74 run.*, nnil conveyed 56 persons to 
the ho(:pitals, 15 home and 1 elsewhere. Ambulance Xo. 4 
made 20 nms, and conveyed 17 persons to the hospitals, 2 
home and 1 elsewhere. (.See Table XIII.) 



SaLK of lNTOXIC.\TIN<i LiQUOR. 

The total number of plnces licensed for the sale of intoxi- 
cating liquor on the first day of .May, 1890 (not including 
druggists and clubs), was 780, being one to every 500 of 
the population, based on the census of 1885. The census 
of this 3"ear gave the city a population of 446,507, and this 
authorized the licensing of ll.T more places. One hundred 
and twelve additional license* were issued in September, 
and Xovcmber 30 there were 8i>2 licensed places in the city. 
Of these, 672 are licensed to sell to be dnmk on the 
premises, or one to every t^fri of the population. 

During the year the licenses of four places were forfeited 
and of two cancelled, but new licenses were issued in their 
places.

Amount paid into the city treasury for license fees, 
$1,012,600. 

At the beginning of the license year the Board issued a 
notice calling the special attention of licensees to the prohibi- 
tion against keeping a public bar, and notif)'ing them that 
all licenses of the first, second and third classes would be 
issued with the distinct understanding that no sales of liquor 
should be made over bars. This regulation has been gen- 
erally observed, customers being served at tables, instead 
of standing at the bar, as was formerly the case. A question 
was raised as to whether serving liquor at tables, unless 
food was served at the satne time, was not a violation of law, 
and, in order to solve the doubt, two test cases were made. 
One case was that of a licensee who did a ]ars:e victualling

business, hut who sen'cd liquor at tables without food. The 
defendant was convicted in the municipal court, but in the 
superior court, in a trial before a jury, he was acquitted. 
The other case was that of a licensee who had all the facilities 
for doinff a victuallin'r business, but who rarely furnished 
food, for the reason that there was no demand for it, 
although there was a limited display of eatables on his 
premises. He w:i> acquitted in the lower court. The result 
of these cases seemed to settle the question as far as the 
courts were concerned, and therefore uo more cases were 
prosecuted. 

The Board again recommends that when licensees die 
before the end of the license ^ear the license l>e continued in 
force, or that a pro rat.T amount be refunded to the legal 
representatives of the deceased. 

Arrests for drunkenness averaged 66 per d.iy during the 
year, or .5.3 per cent, of the population.* There were 1,070 
less persons arrested than in 188P, a decrease of 4. 26 per 
cent. ; 37.31 per cent, of the arrested persons were non- 
residents, and 53.20 per cent, were of foreign birth. Six 
hundred and eighty-four persons were arrested for violation 
of the liquor law, 1.53 less than in 1889 ; and of these, 67.98 
per cent, were of foreign birth. 

Financial. 

Requisitions were m.ide on the city council for the sum of 
$1,171,152.68, to meet the running expenses of the depart- 
ment, incliiduig the pensioned jiolice officers, house of deten- 
tion and station-hou^ matrons, for the present financial ^-ear. 

The total expenditures for police purposes during the past 
year, including the pensions, house of detention, st.-ition- 
house matrons and liquor-license expenses, but exclusive of 
the cost of the police-signal system, were $1,170,019.70. 
From this should l>e deducted the amount received for 
uniform cloth, etc., and paid into the treasury, $8,377.69, 
— leaving the net cost for maintaining the department, 
$1,161,642.01. 

The total revenue p^id into the city treasur3- from fees for 
licenses over which the police have supervision was $1,047,- 
637.40. (SceTalde XIV.)

The totiil payments on account of constructing the police- 
signal system amount to $151,317.17. The cost of main- 
tenance for the year was $50,250.70. 

Pensions and Benefits. 

On tlic 1st of December, 1889, there were eighty pension- 
ers on the roll. During the year eight died and eight were 
added, viz., one ca})tain, one lieutenant, one sergeant, three 
patrolmen and two house- watchmen, leaving eighty on the 
roll at date. A list of pensioners will he found in Table 
XVI. 

The pensions now amount to ?31,5'J5.0() per annum. 

The invested fund of the Police Charitable Fund on the 
1st of ^Nla}', 1890, amounted to s202,950 : cash in trcasur}-, 
$1,173,68; income une.vpendcd, $2,4(54.12. There were 
lift3'-four beneticiarics. During the jear the custody of this 
fund was transferred to the Board of Police. As witness 
fees, which were paid into this fund, were taken away by 
chapter 440, Acts of 1890, the income will be diminished, 
and the number of beneticiarics or the amount paid to them 
will have to be reduced. 

The invested fund of the Police Relief Association now 
amounts to $43,153.99. The pa^'ments for the year amounted 
to $13,821.61. 

Police-signal Sy.stem. 

Wagon houses were completed in divisions 7 and 11 dur- 
ing the year. The patrol wagon went into service in Divis- 
ion 11 February 6, and in Division 7 May 17. The appro- 
priation for construction was insufiicient to i)rovide stables 
in divisions 12 and 13, consecjuently those divisions are not 
yet furnished with patrol wagons. 

There are now in use eleven wagons, eight pungs and 
twent3'-f()ur horses in the patrol service, and one wagon and 
two horses in the repair dci)artment. Two spare patrol 
wagons are kept in reserve. 

During the year the wagons made 24,89(5 runs, covering 
an aggregate distance of 19,000 miles. Twenty-four thou- 
sand five hundred and twelve prisoners were convpycd to the

fetation houses ; 1*31 injured iiiul insane persons were taken 
to station bouses, the hospiUils or their homes ; and 473 lost 
children were taken to station houses. There were 30.3 runs 
to fires, and 465 runs for liquor seizures. 

There were 178,100 telephone messages and 2,23(5,804 
"on duty" calls 9<?iit ever the lines. (See Table XVII.) 

Considerable trouble has been experienced during the year 
from the increasing number of electric wires carrying high- 
tension currents- As the electric-car service Is extended, 
the police telephone ser^'ice is aflfected by induction, and there 
is coiist.int danger of losing instruments by reason of wires 
coming in contact with the trolley wire and conveying the cur- 
rent into the signal Iwxes, burning the works and paralyzing 
the service. In Dirision 14 (Brighton) the Brookline Gas 
Company is using an alternating current of 1,000 volts (the 
most dangerous curreat known to electrical science) for elec- 
tric lighting, and »*reral cases have occurred in which the 
signal apparatus ha* l«en destroyed and the lives of the men 
endangered by the wires coming in contact. It is only by 
constuit supervision and the adoption of new expedients that 
the efCcicncy of the service is maintained; but the time will 
come when defensire measures will cease to be efficient, and 
the Statu or mnnk-ipality will be compelled to intervene 
to protect I)y suitiMe legislation not only the police service 
but the public safely. 

Buildings. 

The work of enlarging and remodelling Police Station No. 
1 was commence*] in Auirust. A building on Cross Street, 
adjoining the old station house, was purchased at an expense 
of $:i8,(»()i). Conti»it5 were made with J. H. Stephenson 
for rcino<lellin«j and connectinsr the two buildings and build- 
ing a cell house, according to plans made by the city archi- 
tect, for the sum of f46,107. It is expected that the station 
will be ready for f»oropancy early in January. 

A new station b<m£e is needed in Brighton. The present 
building does not furnish adequate accommodations for the 
department. 

The business of Dirision .*) has increased to such an extent 
as to necessitate an eufcrgement of the station house. The

sleeping accomiiKHlations are not sufficient for the number of 
men attached to tlic division, and there are not enough cells 
for prisoners. 

Lodging-houses. 

Attention is again called to the desirahility of licensing 
cheap transient lodging-houses. There are now thirty-eight 
of these houses in the city proper, accommodating over 
1,500 lodgers per night. They are to all intents and pur- 
poses inns, excepting that guests are not supjilied with food, 
yet are exempted from the provision of the statute which 
requires inns to l)e licensed. Man}' criminals find lodgment 
in them, and for that reason they should he put under jiolice 
supervision. 

Powers of Police Officers. 

The attention of the Legislature is called to the expedi- 
ency of more clcarh' defining the powers of police officers 
in regard to making arrests without a warrant. At common 
law an officer had the right to arrest without a warrant 
where he had reasonable cause to believe that a felony had 
been committed. Massachusetts Public Statutes, chapter 
210, section 1, provides that any crime punishable b}' death 
or imprisonment in the State prison is a felony. Many 
crimes formerly felonies have b}' statute been made misde- 
meanors by reason of the reduction in the severity of the 
punishment. Furthermore, Massachusetts Public Statutes, 
chapter 215, section 20, provides that a convict shall not be 
sentenced to imprisonment in the State prison for a less 
time than three years. The supreme court of this State has 
recently decided that the latter act so far changed the law of 
felonies that, although certain statutes provide for punish- 
ment by imprisonment in the State prison for a less time 
than three years, yet by reason of this statute those crimes 
are to be no longer considered felonies, and for that reason 
a police officer is not justified in making an arrest for such 
offences without k warrant. As, for instance, the statute in 
regard to the larceny of property not exceeding the value of 
one hundred dullars provides for imprisonment in the State

prison not exceeding one ^ciir, whicli was fonncrly a felony 
and it* now merely a misdemeanor. In such cise, an officer 
making Iho arrest as for a felon}- puts Lim>elf in peril, and 
is linlile to a suit for false arrest. 

In view of the curtailment of the power.'* which officers 
had at common law, and of their furl her aliridgment I>y rea- 
son of cliaptcr 215, section 20, it would seem proper that 
the right of police ofhcers to arrest without warrant should 
lio cxicnded. Furthermore, it is necessar)- for the elBciency 
of IJKi police! service tliiit an officer who, in good faith, 
makes an .irrest without a w.irraut, should not Ik; li:ililc to a 
civil suit for damages.

The annual meeting of the National Encrinipmcnt Grand 
Army of the Republic was held in this city in August last. 
The occasion attracted a large numlier of vi-itors from ail 
purtH of tiie country; hut, notwilh>t;in<ling the fact that 
•luring the week the streets, public conveyances and all 
plac<'H of public resort were tln<uigc<l with ^trangers, there 
was n marked absence of disorder, no 5«rious accidents 
occurred, and no crimes of conse(pienc-e were committed.
