Sir, — In compliance with section 24, chapter 3, of the
Revised Ordinances, the Board of Election Commissioners
respectfully submits its annual report.
Registration
In accordance with chapter 236 of the Acts of 1966
registration was held as follows :
At the central office from 9 a.m. to 5 p.m., Saturdays,
Sundays, and holidays excepted from January 2 to Janu-
ary 20, inclusive; from January 22 to August 7, inclusive;
from September 16 to September 25, inclusive; and from
November 4 to December 31, inclusive.
At the central office from 9 a.m. to 9 p.m. from August
10 to August 14, inclusive, for the State Primaries; from
September 28 to October 2, inclusive, for the State Elec-
tion; from 9 a.m. to 10 p.m. January 21, for the Special
State Election for Representatives in the General Court,
Seventh Suffolk District, Wards 8, 9, and 12; Saturday,
August 15, for the State Primaries, and Saturday, October

At locations in each of the twenty-two wards from
6 p.m. to 9 p.m. from August 10 to August 14, inclusive;
Saturday August 15 from 9 a.m. to 10 p.m. for the State
Primaries; from 6 p.m. to 9 p.m. September 28 to October
2, inclusive; Saturday October 3 from 9 a.m. to 10 p.m.
for the State Election.
Extra sessions of registration were held at the Mini
City Halls located throughout the city from 9 a.m. to
5 p.m. from May 15 to August 7, inclusive, excepting
Saturdays, Sundays, and holidays; from 9 a.m. to 9 p.m.
from August 10 to August 15, inclusive, for the State
Primaries: from 9 a.m. to 5 p.m. from September 16 to
September 18, inclusive; also from 9 a.m. to 5 p.m. from
September 21 to September 25, inclusive; from 9 a.m. to
9 p.m. from September 28 to October 3, inclusive, for the
State Election.
Also a trailer was located on the Boston Common at
the corner of Park and Tremont Streets from June 30 to
August 14, inclusive, from 10 a.m. to 6 p.m. except on
Mondays and Wednesdays when the hours were from
10 a.m. to 8 p.m., and on Saturdays, August 8 and August
15, from 10 a.m. to 8 p.m.
Mobile Registration
The Board of Election Commissioners authorized
mobile units to rove about the city in each ward from
7 a.m. to 10 p.m. from June 20 to August 15, inclusive, for
the State Primaries.
Also the Board of Election Commissioners agreed to
the same procedures for the same hours as stated above
from September 16 to October 3, inclusive, for the State
Election.
The Board of Election Commissioners also agreed to
hold sessions of registration at various shopping centers
in cooperation with the Coordinators of Voters from the
League of Women Voters. These sessions were held for
the State Primaries and the State Election. The same
procedures were followed, in cooperation with the Co-
ordinators of Voters from the All Boston Labor Committee
and the A. Philip Randolph Institute, for the State Pri-
maries and the State Election.
Election Department iii
Physically disabled: In accordance with the provisions
of chapter 196 of the Acts of 1946, persons qualified to
vote but unable to appear at a registration office because
of a physical disability were examined in their homes or
other places of confinement upon receipt of an application
for such registration. Applications were received from
795 such persons. Of that number 496 were found to be
qualified and were duly registered. It was found that
sixty-three of the applicants were previously registered
and on the voting list. Persons so registered or found on
the voting list were furnished with an application for
absentee ballots for the State Election. There were 236
persons requesting such registration who either refused
to be registered when visited or were found not to be
qualified for such registration.
Supplementary registration of federal service personnel:
Under the provisions of chapter 51, sections 50 and 51 of
the General Laws, as amended by chapter 283 of the Acts
of 1966, the time for such registration was extended to
before 4 p.m. of the day preceding a Primary or Election.
There were thirty-six such registrations in Boston.
In accordance with chapter 806 of the Acts of 1970
persons who resided in the Commonwealth less than one
year were allowed to register to vote. Twenty- two per-
sons registered to vote in the Primaries, and fifty-seven
additional persons, for a total of seventy-nine persons,
registered to vote in the State Election.
A special polling place containing two voting com-
partments and a ballot box was set up in Room 241, City
Hall, and persons so qualified to vote were notified by
mail as to its location, in order that they could cast their
ballots.
Number of Voters
At the City Election held November 4, 1969, the num-
ber of voters on the list was 265,064. The number of
voters on the first list published by the Board was 226,850.
From that time to the close of registration for the State
Election there were added the names of 47,328 voters.
Included in this figure are the names of 10,035 voters who
were restored to the voting lists without registration,

under the provisions of chapter 244 of the Acts of 1947.
The number of voters on the final list sent to the polls on
the day of the State Election, held November 3, 1970,
was 274,178, an increase of 9,114 over the number of
voters on the list at the preceding City Election. The
number of voters on the final list December 31, 1970, was
265,064.
Nomination Papers, Referendum and
Recount Petitions
The Board received 4,739 nomination papers for the
State Primaries, on which 93,545 names were certified;
188 referendum petitions, on which 1,686 names were
certified ; and 54 recount petitions for recomits of ballots
cast, on which 469 names were certified. This makes a
total of 4,981 papers, on which the names of 95,700 were
certified.
Model Neighborhood Board Election
The Board of Election Commissioners was ordered by
an ordinance passed by the Boston City Council on
December 23, 1969 and approved by Hon. Kevin H.
White, Mayor of Boston, on December 23, 1969 to conduct
an election of 18 Area Board Members (3 from each area)
to serve as the Model Neighborhood Board. This board
is to represent 6 model neighborhood areas, within the
model cities area by wards and precincts set forth in said
ordinance, and following areas delineated by the Boston
Redevelopment Authority following the guidelines set by
the Federal Government.
The Boston Election Commission designated a re-
compiled 1969 police listing, with supplementary fisting,
to be used as the voting fist for each of the 6 respective
areas, in accordance with the existing ordinance.
A total of 30 candidates filed nomination petitions on
which 2,899 names were certified for the office of Area
Board Member.
The date of the election was set by ordinance as the
first Tuesday in April, 1970. Also, the Board of Election
Commissioners designated 27 polling places in the 6
model city areas.
Election Department v
Recounts
A recount of the votes cast in the State Primaries for the
office of State Senator of the Norfolk-Suffolk District
was held in Wards 4, 10 and 21 on September 24, 1970 :
for Representatives in the General Court in the First
Suffolk District (Ward 1) and in the Eleventh Suffolk
District (Ward 15) on September 22, 1970; for Repre-
sentatives in the General Court in the Fifth Suffolk Dis-
trict (Ward 5) on September 23, 1970; for Representatives
in the General Court in the Ninth District (Ward 13) on
September 25, 1970.
Revision of the Voting List
The names of 3,174 voters were stricken from the
voting list by reason of death, removal from the city, and
other causes.
Jurors
The jury list prepared by the Board in 1970 contained
the names of 7,377 residents of Boston. During the time
covered by this report 5,316 names were drawn for jury
service.
Arsentee Voting
In accordance with chapter 632 of the Acts of 1968
absentee voting applied to the Special State Election.
Chapter 123 of the Acts of 1966 regulating the method of
processing and counting absentee ballots made it manda-
tory that after processing and examination of the affi-
davits in the central office is completed, the absentee
ballots must be sent to the precinct polling places to be
cast and counted; then the said count of absentee ballots
cast had to be added to the count of votes cast by use of
the voting machines, so that the precinct total could be
recorded and reported at the precinct level.
Chapter 363 of the Acts of 1966, further regulating ab-
sentee voting, made it possible for a registered voter who
would be absent from the city on the day of election,
and who had no mailing address outside of Boston to
which a ballot could be mailed and seasonably returned
in time to be sent to the polling place before the closing

of the polls on election day, to receive a ballot in hand
and vote by such ballot in the central office before he
departed from the city.
Set forth below are statistics relating to absentee ballots
in the Special State Election held in the Seventh Suffolk
District (Wards 8, 9, and 12) on February 10, 1970:

Of the 1,977 absent voter envelopes returned and ex-
amined, 230 were rejected for various reasons by the
examiners. None of the ballot envelopes so rejected were

opened to reveal the contents therein. The remaining
1,747 ballot envelopes were subsequently delivered to the
proper polling places prior to 9 p.m., to be cast on the day
of the election as required by law.
Membership of the Board
No change was made in the membership of the Board
during 1970. Commissioner Murphy was designated by
the Mayor to be Chairman of the Board for the term of
one year beginning April 1, 1970. Commissioner Joseph
W. Fitzgerald continued as Secretary.
Expenses of the Election Department
The expenses of the Election Department for the year
ending December 31, 1970, amounted to $751,470.86.

stitution summarized below, which was approved by the General
Court in a joint session of the two branches held July 15, 1968,
received 155 votes in the affirmative and 98 in the negative, and in
a joint session of the two branches held May 14, 1969, received 147
votes in the affirmative and 119 in the negative?
SUMMARY
The proposed amendment to the Constitution authorizes the
Legislature to classify real property according to uses, and au-
thorizes the assessment, rating and taxation of real property at
different rates in the different classes so established, but pro-
portionately in the same class. The amendment further authorizes
the granting of reasonable exemptions and abatements.

received 237 votes in the affirmative and in the negative, and in a
joint session of the two branches held May 14, 1969, received 262
votes in the affirmative and 4 in the negative?
SUMMARY
The proposed amendment to the Constitution abolishes the re-
quirement that in order to vote in a state election a person must
have resided within the Commonwealth one year. If amended,
the Constitution would require only that a voter have resided six
months in the town or district in which he claims a right to vote.

QUESTION NO. 4
PROPOSED AMENDMENT TO THE CONSTITUTION
Do you approve of the adoption of an amendment to the con-
stitution summarized below, which was approved by the General
Court in a joint session of the two branches held July 15, 1968,
received 181 votes in the affirmative and 66 in the negative, and
in a joint session of the two branches held May 15, 1969, received
208 votes in the affirmative and 54 in the negative?
SUMMARY
The proposed amendment to the Constitution amends the exist-
ing constitutional provisions which direct the division of the
Commonwealth into 240 representative districts and 40 senatorial
districts. It provides for a census of the inhabitants of each city
and town in the Commonwealth in the year 1971 and in every
tenth year thereafter. The census in 1971 is to be the basis for
determining the representative and senatorial districts for the ten-
year period beginning January 1, 1975. Each subsequent census
shall be the basis for determining the districts for each ten-year
period beginning the fourth January following each census, so that
the census in 1981 will determine the districts as of January,
1985, etc.
The amendment provides that the house of representatives shall
consist of two hundred and forty members and the senate of forty
members. In its first regular session following each census, the
Legislature shall divide the Commonwealth into two hundred and
forty representative districts of contiguous territory and forty
senatorial districts also of contiguous territory. Each representa-
tive district shall contain, as nearly as may be, an equal number
of inhabitants according to the census. Each senatorial district
shall also contain as nearly as may be an equal number of inhabi-
tants according to the census. A representative district shall not
unite two or more counties, towns, or cities, or parts thereof, or a
city and a town, or parts thereof, in one district unless the same is
unavoidable. Further, no town of less than six thousand inhabi-
tants shall be divided in forming representative districts. It is also
provided that the County of Dukes County and Nantucket County
shall each be a representative district, notwithstanding the fore-
going. The senatorial districts, each of which shall elect one
Senator, shall be formed without uniting two counties or parts of
two or more counties, unless the same is unavoidable.
Each representative shall be an inhabitant of the district for
which he is chosen at least one year immediately preceding his
election, and each senator shall be an inhabitant of the district
for which he is chosen at the time of his election and shall have
been an inhabitant of the Commonwealth for at least five years
immediately preceding his election. Any representative or senator
who ceases to be an inhabitant of the Commonwealth shall cease
to represent his district.
The amendment also provides that the Legislature (1) may by
law limit the time within which judicial proceedings may be insti-
tuted calling in question any such division and (2) shall prescribe
by law the manner of calling and conducting elections for the
choice of representatives and of ascertaining their election.

Finally, the amendment annuls the existing constitutional pro-
visions with respect to apportionment of representative and sena-
torial districts, although those provisions will remain in effect
until January 1, 1975.
