from the U S Court uf Claims, Office of Special Commissioner 

- OURAY Building, Vvashingt n D C June 18, 1909 was returned 

to sender. The letter is as follov/s. June 10 1909

On May 28 1909 I reported to the C, urt of Claims that y 
your application No 12744, for participation in the fund 
arising from the judgment of the court of claims of May 28, 
1906, in favor of the Eastern Cherokees, should be rejected, 
and on June 10 1909 the C^urt entered an order as follows: 
■'It is further ordered "that the said roll of individual 
Eastern Cherokees entitled to share in the fund arising from 
the judgment in this caase, as reported by Special 
Commissioner, GUION ZILLt^R, on 28 I.lay 1909. be and the 
same is hereby ap Toved, ratified and confirmed, except as to 
so much of the same as shall be soecially excepted to on or 
before the 30 August 1909. All. such exceptions shall be 
forwarded to tho Cler': of the C urt of Claim.s, Washington DC 
and shall be in writing, and shall state fully the grounds 
upon which such exceptions are based and shall be supported 
by an affidai'it of a person having knowledge of the facts 
and shall contain the nam.e age and postoffice address of 
each Individual clc. 1 isd to have been omitted from said roll, 
or to have been improperly placed thereon. Said exceptions 
and affidavits shall oe f II3 d in duplicate in each case, but 
only the originals must bs avi^rn to. In case an exception 
is filed on behalf of an individual whose name has been 

omitted from said roll to^e said exception shall set forth 
fully the English and Indian name of the ancestor through 
whom claim, is m^ade, who was living in 1835 or 1851, and 
shall give the ago of said ancestor in 1835 or 1851. 
Such exceptions hust further state the number of the climant' 
ap..licaticn. All such exceptions shall be set foim for 
hearing on the third Monday in Oct 1909. 

No exceptions or letters, not strictly complying 
with the requirements of the above order of the Court in 
regard to the filing of exceptions will be considered.
