HOUSE.... ....No. 33.

ABSTRACT OF THE ANNUAL REPORTS

ATTORNEY FOR SUFFOLK COUNTY

DISTRICT ATTORNEYS.

9mm¥io(Mtt. m m m

Feb. 1844.] HOUSE— No. 33.

^ommonUjealUj of jHassacijusrtts*

Secretary's Office. Boston ; February 17, 1814.

To the Speaker of the House of Representatives.

Sir:

I herewith transmit to yon, to be laid before the Legislature,
the Abstract of the Annual Report of the Attorney for the
County of Suffolk, and the District Attorneys, required by the
act of 1843 (chapter 99) to be prepared by the Secretary of
the Commonwealth.

I have the honor to be,

Very respectfully,

Your obedient servant,

JOHN G. PALFREY, Secretary.

1844] HOUSE— No. 33.

a^ommoniatnltf^ of ^auuntfinfitttu.

STATISTICS OF CRIME.

The Secretary of the Commonwealth, in comphance with
provisions of law, respectfully submits to the Legislature an
Abstract of Reports made by the Attorney of the County of Suf-
folk, and the Attorneys of two Districts, for the year 1843.

No reports have been received from the Northern or Southern
District ; and the report from the Middle District is made by
two Attorneys (there having been an appointment to that
office during the past year), who have adopted different forms.

The form of Abstract heretofore used by the Attorney Gene-
ral, has been adopted; but, as the classification under the title
"Other Misdemeanors" must be entirely arbitrary, it has been
so far altered as to admit a specification of the offences not
necessarily coming under either of the previous titles.

The first table is of cases in the Municipal Court in the
County of Suffolk. The comprehensive report of the attorney
for this county also embraces a list of forty-six cases, in which
he appeared for the Commonwealth in the Supreme Judicial
Court, (one of which was a trial for murder, occupying the
court four days,) and a list of forty-three cases, in which he
appeared for the Commonwealth in the Court of Common
Pleas. His opinions were given in writing upon twenty-one
requisitions, on or by the Executive, for fugitives from justice.
In a memorandum at the end of his report, he says, " There
is a process against the Phcenix Bank, in the name of the Com-
monwealth, commenced [in the Court of Common Pleas] by Brad-
ford Sumner, Esq., as attorney of record. I have never been
consulted concerning it, and it has never been under my control

6 ATTORNEYS' REPORT. [Feb.

or management. By whose authority it was commenced, or
still is prosecuted, I know not. It yet remains in that court."

The tables from the second to the seventh inclusive, show
the number of prosecutions, with their causes and results, con-
ducted by the local officers in the several counties, reports from
which have been received.

In the first seven tables, under the title " against the person
feloniously," are included cases of felonious assault, assault and
battery with a dangerous weapon, robbery, attempt to commit
rape, and one case in Suffolk County, of an attempt to commit
fornication with a female child.

Under the title "against the person not feloniously," are in-
cluded cases of assault and battery.

Under the title " against property with violence," are includ-
ed cases of arson, burglary, and shop-breaking. Under the
title " against property without violence," are included cases
of embezzlement and larceny.

In the absence of reports from the attorneys of the Northern
and Southern Districts, materials do not exist for tables corres-
ponding to the residue of the first thirteen tables in the Attor-
ney General's Abstract of last year.

The eighth table corresponds to the fourteenth of the Abstract
of last year.

Materials for a table, corresponding to the fifteenth of last
year, are not contained in the reports of attorneys, lodged in
the Secretary's office.

The ninth, tenth, and eleventh tables, corresponding to the
sixteenth, seventeenth, and eighteenth of last year, were fur-
nished by the kindness of the Treasurer for the County of
Suffolk.

The materials for the twelfth table, corresponding to the
nineteenth of last year, which, for want of reports from two
districts, could not otherwise have been made complete, were
obtained from the books of the State Prison. A recapitulation
is annexed to this table, exhibiting in a single view the number
of convicts from the several counties.
