the Abstract of the Annual Reports of the Attorney for the
county of Suffolk, and the District Attorneys, required, by the
Act of 1844. chap. 87, to be prepared by the Secretarj'- of the
Commonwealth.

ABSTRACTS.
SUFFOLK COUNTY.
The Attorney for Suffolk returns sixteen hundred and sev-
enty-two complaints, sixty-four of which were commenced in
1847, and disposed of at the January term of 1848. He has
also attended to forty-nine cases in the Supreme Judicial Court,
and to one case in the Court of Common Pleas.
Upon the application of the Governor, the Attorney reports,
that he has given thirty written opinions relative to the arrest
of fugitives from justice. He has also given written and oral
opinions to, and drawn up legal papers for, the Treasurer, and
Adjutant General of the Commonwealth, and the Superintend-
ent of Alien Passengers.
The Attorney reports, that he has paid over, to the Treasurer
of the Commonwealth, thirteen hundred and forty-four -j-V^ dol-
lars, collected from the penalties of recognizances, and that the
Sheriff of Suffolk has paid to the County Treasurer, in 1848.
fourteen thousand six hundred and thirty-three y^^r dollars for
fines and costs received by him in the Municipal Court of the
City of Boston.
The Attorney for Suffolk closes his Report with the follow-
ing remarks : — " It is apparent, from the exhibits in this Report,
that there has been a very large increase of criminal business
in the county of Suffolk, during the past year. The cases on
the docket of the Municipal Court only, are sixteen hundrep
and seventy-two. In the Supreme Judicial Court, there also
has been a great increase of capital trials, and of very import-
ant law questions, in which the Commonwealth was a party :
and it has been clearly perceived, by the judges of the courts,
by the grand and traverse juries, and by the members of the
bar, that the proper administration of the public justice in this

county requires the time and services of more than one prose-
cuting officer. If the criminal business increases hereafter as
heretofore, it will be physically impossible for one person to
perform it. The excessive and unremitted pressure of official
duty has already undermined my health ; unremitted profes-
sional labors, night and day, with no vacation and no assist-
ance, and perpetual confinement daily and all day, in badly
ventilated court-rooms, will break down the best constitution ;
and I hesitate not to say, that I feel it a duty to ask for relief
in such a manner as shall seem best to the wisdom of the Legis-
lature to provide it. If it cannot be obtained, I must retire from
an office too onerous to be borne by one unassisted individual,*'

EASTERN DISTRICT.
By the act of 1S48, chapter 10, it is provided, that, '' for the
administration of the criminal law in this Commonwealth, the
comity of Essex shall constitute a separate district, which shall
be the Eastern District." Previously to the passage of this act.
the county of Essex had formed part of the Northern District.
The Attorney for the Eastern District reports as follows : —
"I have been in actual attendance on the courts, during the
past year, in the transaction of criminal business exclusively,
not less than fifteen weeks — about fourteen weeks of this time
in the Court of Common Pleas. I think the amount of criminal
business in this district, the past year, and for many years
past, if former reports are examined, will show a clear and
urgent necessity for the separation of the criminal from the civil
business of the Court of Common Pleas, by the establishment
of a suitable number of terms of that court for criminal busi-
ness exclusively, as in some of the other large districts of the
Commonwealth. The considerations in favor of such an ar-
rangement would seem to be so obvious, that they need not be
alluded to any further than the bare statement of the time ac-
tually consumed the past year, in the Court of Common Pleas,
in the exclusive transaction of criminal business, during all
which time the civil business has been suspended and greatly
delayed. I trust the Legislature, in its wisdom, will provide a
remedy which will remove the present ground of complaint in
this behalf"
