Party of the first part hereby agrees to have planted During the Season of 1919 an acreage of seeds or roots sufficient, under normal con- ditions, to produce the quantities of seeds herein speci- fied, and in the event of a short crop, to deliver pro rata amounts in full satisfaction of this contract (or to plant such acreages as may be agreed upon and to deliver the entire yield of such acreage so planted, such agreement to be in writing and to be a part of this contract.) The party of the first part further agrees to deliver the seeds so contracted for at the prices annexed in good merchant- able condition F. O. B. growing station. The party of the second part hereby agrees to accept such seeds in kinds and quantities, and at prices as herein specified, and in the event of a short crop to accept pro rata delivery in full satisfaction of this contract and to pay for the same on the following terms: 60 days acceptance from date of shipment or two per cent, dis- count for cash in 10 days from date of invoice. Ship- ment to be made as soon after harvest as possible. It is further understood and agreed to by the party of the second part that the party of the first part gives no war- ranty, express or implied, as to description, quality, pro- ductiveness, or any other matter of any seeds they send out, and that they will not in any way be responsible for any crops produced therefrom, and that only under these conditions is the above order accepted and booked by them at the low prices named.
