2011 ANNUAL REPORT % CHESAPEAKE BAY FOUNDATION Saving a National Treasure A Message from the Chairman After serving proudly on CBPs board since 2003, 1 was honored to take over for my friend and colleague Keith Campbell as chairman earlier this year. Restoring the environment is my life’s work and my passion. I have worked with and for several excellent environmental organizations. In my view, none is finer than CBF, and no time is more important for the Bay than right now. Because of the work CBF has been doing for 40 years, the possibility of a cleaner Chesapeake Bay-healthier water, abundant wildlife, and economic opportunities that come with a healthy environment-is at hand. We have charted a clear path to that vision-science-based limits on allowable pollution to the Bay and state-drawn plans to achieve those limits in the near term. And our education and outreach efforts have built a membership and constituency base of passionate people who give generously, volunteer tirelessly, and act to support the goals we share. There’s an old adage that “you know you’re in the sweet spot when you get pushback.” If that’s true, then we are in a very sweet spot indeed. The headlines almost every day are depressing. The rhetoric of many of our elected officials is hyperbolic, without foundation, and often disregards science and the law. Powerful forces are spending staggering sums of money to derail the Bay pollution limits and destroy EPA, despite common sense and public will. And even Mother Nature seems to be conspiring against us, with back-to-back storms and torrential rains late last summer throwing the Bay a tragic double-whammy that may be felt for years. But I’d rather be negotiating from the sweet spot we find ourselves in than from almost any other place. The challenges facing us are huge. You might say we’re in a David-versus-Goliath fight, but it’s a fight we’re going to win. We’re going to protect the laws and agencies responsible for restoring clean water in our nation, we’re going to see to it that the state plans are fully implemented, and we’re going to set an example for the rest of the world. Now that’s a sweet spot. Simon Sidamon-Eristoff CBF’s mission: Save the Bay. We define that as a Bay with a health index of 70 ( out of a possible 100). At 70, the Bay’s waters will be clear, thanks largely to a dramatic reduction in the amount of nitrogen, phosphorus, and sediment pollution entering the system. The water will have oxygen levels sufficient to support living resources in all parts of the Bay, and it will be largely free of toxic contamination. Founded in 1967, CBF is the largest regional conservation organization dedicated solely to saving a national treasure — the Chesapeake Bay and its rivers and streams. With headquarters in Annapolis, Maryland; state offices in Maryland, Virginia, Pennsylvania; a federal office in the District of Columbia; and educational centers and programs across the region; CBF works throughout the 64,000-square-mile Chesapeake watershed to build an informed citizenry, advance pollution reduction, and encourage enforcement of environmental laws. CBF is supported by more than 200,000 members and e-subscribers and has a staff of 1 70 full-time employees. A Message from the President The Chesapeake Bay is breathtakingly beautiful. It’s a national treasure, America’s largest estuary worth more than one trillion dollars, home to 17 million people, and populated with iconic Bay critters. But despite some recent signs of improvement, the Chesapeake still suffers from far more pollution than science says it can handle. Persistent pollution creates huge dead zones, puts human health at risk, and destroys jobs. The Bay’s best hope for salvation-strong and enforceable pollution limits-is finally in place. But the plan’s longevity is fragile. Some of the nation’s most powerful agri-chemical lobbyists and lawyers are working in Congress and federal court to derail it. We intend to stop them in their tracks. Let’s review how we got here. Frustrated by a quarter century of broken promises, CBF and our allies sued the U.S. Envi- ronmental Protection Agency three years ago. This lawsuit ended favorably when EPA signed a settlement agreement and agreed to establish the holy grail of Bay restoration. Called a “Total Maximum Daily Load,” orTMDL, it creates mandatory pollution limits for the Bay.The limits are designed to cut pollution to sustainable levels. The reductions will require Bay states to reduce pollution by some 25 percent over 15 years. The limits are the minimum science says is necessary to restore the Bay to balance. CBF knows that the Bay is at a turning point, with signs of hope-including a resurgence of blue crabs. Throughout 2011, we defended the pollution limits with every tool we have. We’ve been educating the public about the issue, advocating, litigating, and organizing projects that inspire citizens to become activists for our cause. We can protect the Bay pollution limits, and we can save the Bay. But to achieve this, we need your help now more than ever. Let’s commit ourselves to making 2012 the Year of the Bay. i EDUCATE Inspiring people to care about the Chesapeake Bay has been at the core of our mission for more than four decades. Motivation springs from knowl- edge. And CBF disseminates critical knowledge about the Bay several ways-including through the news media and Internet and through education programs that lead children and adults on outdoor learning experiences that change lives. From July 1, 2010, to June 30, 2011, as the new Bay pollution limits, known legally as a Total Maximum Daily Load or TMDL, were being launched and debated, CBF met with newspaper editorial boards and re- porters to explain the need for the TMDL to the public. On March 17,2011, The Baltimore Sun editorialized that the Bay pollution limits are “the most hopeful effort toward cleaning up the estuary in a generation” and that recent efforts by the American Farm Bureau Federation to derail them “should be an embarrassment to farmers everywhere.” CBF inspired or was mentioned in articles that framed the issue for lawmakers and voters an average of five times a day over the last year. We also explained the pol- lution limits via Facebook, blogs, e-mail, and our Save the Bay magazine; and created detailed web pages to inform people (cbf.org/tmdl). Among those providing support for our work is the Ernest E. Stempel Foundation. The best way to shape the hearts and minds of voters and decision makers is to get them to fall in love with the Bay when they are young.To that end, CBF operates the largest and most successful environmental education program in the country. In fiscal year 2011, our educators guided 23,509 students, 2,682 teachers (a record for CBF), and 30 principals on outdoor education experiences. A great triumph for CBF’s educational approach came on June 21, 2011, when the Maryland State Board of Education voted to make environmental literacy a high school graduation requirement-a first in the nation. Some local school districts are working to not only meet this new requirement, but to go well beyond it. Anne Arundel County, Maryland, for example, is working with CBF to launch a program that will take every student on an 2 ◄ Outdoor learning at CBFs Port Isobel Center is funded by James E. Other general education funds come from Maersk Line, Limited. outdoor learning expedition every year. Teacher training in Anne Arundel County and across the region is funded in part by the National Oceanic and Atmospheric Administration’s Bay Watershed Education and Training (NOAA B-WT ) program and the National Geographic Education Foundation. In a major step towards environmental literacy in Virginia, CBF is also working with the Virginia Beach City Public Schools to develop a model, system-wide environmental education program.They are training the city’s sixth-grade and high-school teachers to take what today are largely class- room-based science courses and add field-based educational experiences that greatly enhance their value. This would not have been possible without generous support from CSX Corporation. At the Norfolk Academy, CBF helped to create a fellowship program that takes students on five-day leadership training trips and then allows them to focus on the Chesa- peake’s ecology and culture during four years of study. Wells Fargo supports CBFs education programs in Hampton Roads, and the Bama Works Fund is behind our efforts in both Hampton Roads and Charlottesville. In Pennsylvania, CBF partners with the York City and York County Public Schools to bring teachers on five-day learning expeditions-on canoe and foot-that allow them to better educate their students about their connection to the Bay. Mr. and Mrs. Louis J.Appell, Jr., are key contributors to this effort. CBFs innovative educational programs would be impossible without generous contributions from the Dixon Hughes Goodman LLP, the Howard Hughes Medical Institute,! Rowe Price, Lockheed Martin Corporation, and the Laverna Hahn Charitable Trust, among others. 3 ADVOCATE Intense battles over the Bay pollution limits raged this past year in both the U.S. House of Representatives and in state governments. In Con- gress, CBF defended the new pollution limits in a clash with an army of lobbyists for the American Farm Bureau Federation, The Fertilizer Insti- tute, the National Association of Homebuilders, the National Chicken Council, and the National Pork Producers Council, among others. Another threat came from U.S. Representative Robert Goodlatte of Virginia, who sponsored an amendment to a federal budget bill that would have stripped all federal funding for implementing the Bay pollution limits this year. The Goodlatte amendment passed the House with a 230-195 vote on February 18, 2011, but then died in the Senate because of timely opposition from several members in the chamber. At the state level, CBF rallied thousands of its members to write the governors of Virginia, Maryland, and Pennsylvania. Our supporters joined us in pushing the states to create stronger and more specific plans to meet the pollution limits, and the campaign was remarkably successful. Virginia Governor Bob McDonnell tightened up his state’s pollution-reduction plan after CBF commissioned a poll by McDonnell’s own pollster that found Virginians-by a nearly two-to-one margin— would prefer the state establish its own plan to reduce pollution in the Bay, rather than wait for EPA to do so for them. As part of this effort, CBF convinced cities and towns in the Hampton Roads area not to sue to block the pollution limits.To help the states meet the pollution limits, lawmakers in both Virginia and Maryland-at CBF’s urging— passed laws restricting the amount of nutrient pollution allowed in lawn fertilizer. Meeting the limits would be even harder if a new coal-fired power plant-the largest ever proposed for Virginia-were built by the Old Dominion Electric Cooperative (ODEC) outside Hampton Roads. As part of a continuing public crusade to prevent construction of the plant in Dendron, CBF researched and released an investigative report, “A Coal Plant’s Drain on Health and Wealth.” 4 ◄ Advocacy activities in Maryland are funded in part by The Abell Foundation, Inc. Volunteers clean up trash and debris as part of the 23rd annual Clean the Bay Day in Virginia, supported by Portfolio Recovery Associates, Inc. In Maryland, Governor Martin O’Malley approved a pollution-reduction plan that was considered the most comprehensive by EPA. Maryland’s plan includes continued funding for innovative farm and urban runoff control projects through the Chesapeake and Coastal Bays 2010 Trust Fund, which CBF helped craft. And in Pennsylvania, CBF encouraged the state to launch a strategy to help meet the pollution limits in part by convincing farmers to comply with existing state regulations. Many farms today do not have required erosion control and manure-management plans, and simply bringing them into compliance will greatly improve local water quality and the Chesapeake Bay. CBF’s energetic advocacy work owes its existence to support from the Linden Trust for Conservation; Mr. and Mrs. William C. Clarke III from Monkton, Maryland; and Gray Charitable Trusts; among others. 5 LITIGATE Chesapeake region states and EPA signed agreements to clean up the Bay in 1983, 1987, and 2000, setting deadlines first in 2000 and then in 2010. When it became clear to CBF that the second deadline would be missed-like the first, by a wide margin-we and our allies sued EPA. We sought accountability for the 2000 agreement and a stronger federal role in overseeing Bay restoration efforts.The fruit of that lawsuit was a historic settlement with EPA. The Washington Post praised the agreement as a “landmark” and a “milestone” that promised “environmental progress in the Chesapeake Bay.. .rare as a pearl in an oyster.” Among other benefits, the settlement agreement helped set the December 31, 2010, timeline for EPA’s development and implementation of the pollution limits (the Bay TMDL) and for the states to create their plans to meet those limits. Less than two weeks after EPA released the science-based pollution limits, they were challenged in federal court by the American Farm Bureau Federation and the Pennsylvania Farm Bureau. Several other special interest groups-including the National Association of Builders— later joined in opposition. (Please see page 4.) These groups are not to be confused with family farmers or construction workers. They are national industrial giants with strong anti-regulatory agendas that together spend more than $15 million a year on lobbying and campaign contributions. On May 25, 2011, CBF joined with several partners in filing a motion in federal court to intervene in the lawsuit on behalf of EPA and defend the new federal pollution limits. Our motion was approved in October and so CBF will now actively defend the pollution limits in court. CBF also took legal action to protect the Chesapeake Bay watershed from damage from gas drilling in the Marcellus Shale formation. On April 4, 2011, we filed a legal petition to EPA and the White House Council on Environmental Quality calling for a comprehensive federal study of the cumulative environmental and human-health impact of hydraulic fracturing for natural gas in the shale formation under New York, Penn- 6 ◄ CBF’s efforts to protect the environment from drilling-related pollution are supported in part by The Forrest C. and Francis H. Latner Foundation and The Indian Point Foundation. Crabbers and many others depend on clean water. CBFs fight for a healthy Bay is supported by The J. Willard and Alice S. Marriott Foundation. sylvania, West Virginia, Maryland, and Virginia. CBF also challenged three questionable drilling permits in Pennsylvania state court. And in July 2011, CBF reached a settlement agreement with the state and the drilling companies that prohibits drilling in floodplains and ends fast- track permitting for drilling rigs near high-quality streams. CBF’s lawsuit over toxic contaminants seeping from the Sparrows Point steel facility in Baltimore County continues, despite a setback in July 2011 when a judge ruled the current owners are not responsible for pol- lutants from past owners. Still pending are CBFs arguments that the owners failed to obtain proper permits or bonding for hazardous waste storage facilities and erosion and sediment control. Many donors make CBFs ground-breaking legal work possible, in- cluding The Lenfest Foundation; Jean T. and Heyward G. Pelham Foundation; Rebecca J. Simmons of New York, New York; and the Cynthia Weglarz Rountree Fund. 7 RESTORE Restoring nature’s filters-oysters, trees, and underwater grasses-is also critical to saving the Bay. CBF trains and encourages our volunteers to plant these filters. We invest time on farms, showing farmers how to grow their crops and graze their livestock in ways that are as healthy for their streams as their bank accounts.The benefits of our restoration efforts are multiplied because when we engage people in these projects, we change them. They are no longer observers of the Bay’s problems, but become invested partners in our struggle to save the Bay. They write letters, make phone calls, and take other actions to help us defend the Chesapeake Bay. CBF’s oyster restoration centers grew more than 22 million oysters in the fiscal year that ended on July 1, 2011. We planted these young oysters on sanctuary reefs in the Severn, Choptank, and Patuxent Rivers in Maryland; and the Piankatank and York Rivers in Virginia. To help obtain enough oyster shells for these projects, we worked with partners to recycle hundreds of shells from restaurants and other sources. CBF built 440 perforated cement orbs called “reef balls,” upon which oysters grow. To encourage aquaculture, our oyster restoration center in Maryland also started an initiative that allows local watermen to use one of CBF’s oyster-growing tanks, free of charge. CBF’s oyster restoration and fisheries management efforts are supported by the National Oceanic and Atmos- pheric Administration, Restore America's Estuaries, the Charles! Bauer Foundation, The Port of Virginia, and The G. Unger Vetlesen Foundation. In Maryland, a CBF-led coalition of farmers who teach each other about the benefits of grass-fed livestock grew this year to 30 participants. The Maryland Grazers’ Network efforts reduce pollution in streams while also producing healthier-and frequently more profitable-dairy herds. Farm animals that eat grass do not rely on corn, which requires the use of fertilizers, pesticides, and herbicides that can be washed by rain into waterways. The program is supported by the Chesapeake Bay Funders Network, and run out of CBF’s Clagett Farm in Upper Marlboro, Maryland, which is supported by The Morris and Gwendolyn Cafritz Foundation. 8 ◄ CBF and its partners launched the Lafayette River Project in Virginia to renew an urban waterway. In Pennsylvania, CBF worked with farmers to plant more than 100,000 trees along 83 miles of streams, creating natural vegetative filters that absorb fertilizer and sediment pollution. CBF's effectiveness in using federal funds to create these buffers inspired EPA to honor CBF nation- ally with its PISCES Award. The Growing Greener Grant Program of the Pennsylvania Department of Environmental Protection, the USDA Natural Resources Conservation Service, the Richard King Mellon Foundation, and Donald W. Hamer of State College, Pennsylvania, are among the key supporters of CBF’s farm stewardship programs. CBF’s program to educate Amish farmers about ways to reduce runoff pollution is supported by the Claneil Foundation, Inc. In Virginia, CBF and its allies launched the Lafayette River Project in April 2011, funded in part by the National Fish and Wildlife Foundation with funding from EPA. This is an urban community watershed restoration project in Hampton Roads that includes public education, water-quality monitoring, oyster gardening, rain-garden building, and more. 9 RESOURCES Despite recent economic uncertainty, CBF supporters have stood loyally by our side. You have helped us capitalize on unique opportunities to re- store the Bay, such as our lawsuit against EPA and the creation of the new pollution limits. Our determined advocacy has driven policy breakthroughs that CBF has been working towards for decades. And now our supporters realize how critically important it is to keep donating to our cause to de- fend these breakthroughs, so that our progress continues. One example of a time-sensitive opportunity that CBF is determined to seize-despite the economic downturn-is the protection of one of the last remaining natural waterfronts in Virginia Beach. CBF is working with the City of Virginia Beach and The Trust for Public Land to save 122 acres of beaches, trees, and wetlands along the Lynnhaven River. This gorgeous and environmentally sensitive piece of land, called Pleasure House Point, was, until recently, threatened by developers who wanted to build more than 1,000 homes there. But now CBF is leading a campaign to help preserve the land and use a small part of it to build an environmental center. The design of this exciting new facility and site will be one more example of how CBF practices what it preaches. The “net-zero” building site will serve as a model of sustainable design and will house CBF and other environmental partners’ programs to advocate for the Bay and educate local students and the public about the Chesa- peake. CBF also plans to restore the area’s natural filters by planting oysters in the Lynnhaven River and natural grasses on the property. At our headquarters in Annapolis, we recently installed two charging stations for electric vehicles. The Baltimore-Washington Electric Vehicle Initiative donated these stations. We also added four clean diesel engines to our education vessels (thanks to support from EPA’s Clean Diesel Program) and installed nitrogen-removing equipment to the septic system on our Holly Beach Farm in Maryland. Increasingly, CBF is turning to innovative ideas that simultaneously provide a useful service to the community and protect the environment. ◄ CBF and partners are working to preserve a threatened natural waterfront at Pleasure House Point in Hampton Roads, Virginia. The fourth annual Akridge Save the Bay Classic golf tournament was sponsored by 25 regional corporations including Marriott International, CarMax Laurel Toyota, and Bambeco. This approach is at the heart of, for example, a partnership between CBF and Farm Fresh. Every time supermarket customers bring a reusable cloth bag to the supermarket instead of asking for a plastic bag, five cents is donated to CBF’s education, advocacy, and restoration programs.
