It is only proper that the names of those to whose labours the Society owes this volume should be put on record. The Rev. R. C. Bates, late Rector of Churchill, provided the transcript of the Register. Mr. J. Rusling has been good enough to undergo the drudgery of the index. For everything else we have to thank Mr. Willis Bund. He has not only written the introduction but has also found time to see the volume through the press.

Churchill in Oswaldslow, so called to distinguish it from Churchill in Halfshire, is a small country parish five miles south-east of Wor- cester. It has an area of only 670 acres.

The first point of interest about it is that the population is now almost exactly the same as it was in 1562. It then contained 1.1 families; applying the rule of 5 to a family made it 55. By the census of 1891 the population was 54, in 1901 45, in 191 1 65. It might be expected that such a parish would be one of the happy o-nes that has no history. The Registers, however, give not merely the births, marriages and deaths from 1564, but furnish materials for a very interesting local history. There does not appear to have ever been a resident Squire. Possibly one result of this is that the same people seem to have gone on living in the parish year after year without change ; the same names occur over and over again, until it almost becomes a family history.

The Registers have also another point of interest ; they continued without the usual break through the Civil War, and this gives rise to one or two special points.

The parish was in the Forest of Feckenham, and this may account for some of the entries in it. At one time the Courts for the Hundred of Oswaldslow were held at Churchill, under a great oak tree there. This may possibly be the oak mentioned in the Register as " Crosse Heathe Hocke. " The heath has been enclosed for years and the oak tree has, it is believed, long ago vanished.

The Registers before 181 2 consist of two volumes. No. i is a vellum book ii|in. x8 containing 33 leaves of vellum, written on both sides. It begins with Marriages 1564, Baptisms 1565, Burials 1566, and extends till 1748. There seems to have been no marriages between this year and 1752, when Lord Hardwicke's Act (26 George II. c. 33) came into force requiring the entries of all marriages to be made in a separate book. This separate Register forms Vol. II. of the Churchill Registers before 1812. It consists of a Banns Book with 15 entries 1762-1792 and the Register with the entries of 32 Marriages between 1762 and 1810. All others are missing, if they ever existed.

The Register records the work of 10 Rectors, and the best way of calling attention to the points of interest will be to deal with the tenure of each Rector in turn.

The list of Rectors from the Register differs in certain respects. It runs as follows :

According to the Register, Rawlingson was Rector at least as far back as 1568, as in that year he signs the Register at the bottom of the first leaf as incumbent (clericus). Nash states he was not instituted until the 2nd October, 1581. Neither Nicholas Dawes nor Jaspar Brittaine are given by Nash. As to Dawes, as already stated, all that is known is the entry of his burial. Brittaine is, however, a more important person. Barker, who had been presented as far back as 1613, held the living all through the Civil War, one of the few Wor- cestershire Rectors who did so. It will be noticed that although he is spoken of as Rector when his name appears in the Register, he never signs the Register as Rector after 1639, but in the entry of his burial he is so described. So far as the Register goes it would be said he was not interfered with. But in the " Worcestershire Association '* of Ministers, drawn up in 1653 by Richard Baxter, among the signatures is the name of " Edward Boucheir of Churchill." It is not clear to which of the two Churchills this applied. For Oswaldslow it may be said that there was a small group of Associated Ministers in the Per- shore district, such as Pershore, White Ladies Aston, and Naunton Beauchamp, and it would be most likely that Churchill would belong to this group. On the other hand, Churchill in Halfshire was nearer Kidderminster, the centre of Baxter's influence, and as it belonged to the malignants, the Lytteltons, he would take especial care to see that the parishioners had the pure Word preached to them by an Associated Minister.

A still more difficult point remains, how was the vacancy on Barker's death filled up? In other words, who presented his successor Brittaine? There is absolutely no record. Brittaine was a University man, a Bachelor of Divinity. The entry in the Register when his name first appears is *' Jaspar Brittaine Sacrae Theologiae Baccalaureus Rector *' Ecclesiae de Churchill," and although he does not sign his name to the Register as Rector until after the Restoration, he so signs in 1661, yet he always, in any entry about himself, describes himself as Rector of the parish, as in entries in 1655, 1658, and 1659. He certainly accepted the Restoration Settlement and remained Rector until 1668, and in the entry of his burial is described as " Rector of the parish of "Churchill."

Two other points as to this should be noticed, before the church at Churchill underwent the process of restoration, there were two flat stories on the floor, one to the memory of Thomas Barker, which bore the inscription : " Here lieth the body of Thomas Barker S.T.B. Minister of " this Parish aged 77 who was buried the i8th day of August 1654."

This looks very much as if whatever Barker might describe himself in the Register, his friends thought it well to use the term Minister as synonymous with Rector. Not so Jaspar Brittain. On another stone

was inscribed " Exuviae Brigettae Brittain cujus carissimus maritus " Jaspar Brittain hujus ecclesiae rector marmor hoc posuit 13 Julii " 1655 " ; and on another *' Martha Brittaine filia Jasparis Brittaine " hujus ecclesiae rectoris obiit Feb. 24 anno domini 1659 aetatis suae 14."

It is not known when these stones were placed, whether before or after the Restoration. If after, the use of the term Rector would be a matter of course ; but if before, then the public use of the word Rector by Brittaine on the tombstone as well as the private use in the Register go to prove that however much his title may have been doubted by rabid Royalists he was recognised as Rector of the parish, no matter who presented him or how he came by such preferment.

John Rawlingson does not appear to have been a University man. He was presented by Philip Sheldon, who then owned the estate but shortly afterwards sold it to the Berkeleys, whose descendants now hold it. John Rawlingson appears to have been a member of a Wor- cester family. His son Elias Ely or Hebras was a mercer in Worcester, and is said by the inscription on his grave (as given in Nash) to have been Sheriff, Mayor and Alderman of Worcester. His name, however, is 'not included in the list of Mayors set up in the Worcester Guildhall. He was probably the Elias Rawlingson whose name appears in the St. Helen's Register in 161 1 as Elias Rawlingson who married Ann Otly there on the 22 January in that year,* as on another stone in Churchill Church was an inscription to Ann Rawlinson of the City of Worcester, widow, who died on the 3rd Jan., 1687, but, curiously, there is no mention of her burial in the Churchill Register.

Whoever and whatever the Rector of Churchill was we are indebted to him for two things ; he wrote a very good hand, easy to read, and he utilised his register not merely to insert in it the usual entries of Baptisms, Marriages and Burials, but to record any of the parochial events which he considered were worthy of being recorded. From this we get a body of local history that could not be found elsewhere. The tales that he tells are here given as nearly as possible in his own words.

The first entry of importance is the burial in 1597 of Ralph Sowley, the incumbent of the neighbouring parish of Broughton Hacket, probably a Churchill man. He was presented by Queen Elizabeth to the living in 1592. Among his parishioners were a married couple named Goold. After Sowley had held the living five years, in 1597, on the 25th April, being the feast day of St. Mark, Mrs. Goold and the Parson, Ralph Sowley, murdered her husband Thomas Goold. He was tried, most likely at the Summer Assizes, as the execution was on the 19th August, sentenced to death and hung, probably at Red Hill, Wor- cester. As far as is known no details of the murder have survived, but the story of the Parson of the parish conspiring with the wife of one of his parishioners to kill the wife's husband has all the elements of a highly sensational romance. One point is of interest. How was his body obtained for Christian burial, and why was it buried at Churchill? There is not enough known of the facts to be able to answer the first, nor why the parson was not gibbetted in his own parish. As the law then stood he should have been so treated near the spot where the murder was committed. If his friends were able to obtain possession of the body, the Register gives a possible clue as to why he was buried in Churchill. For at least 29 years a John Sowley had been Church- warden of Churchill, the Sowleys seem to have been a Churchill family, as there are frequent references to them in the Register. The friends of the Broughton Hackett parson may well have desired that his body might rest in peace in his own parish among his own kindred. Nothing appears with regard to Mrs. Goold, whether she was tried and

convicted, or not. This is to be regretted, as in those days the murder of a husband by his wife was Petit Treason, and the punishment was to be burnt to death.

Two other entries throw some light as to how the law worked in those days as to suicides and supposed suicides. It is curious that one of the cases also relates to the Sowley family, one of them, William, who was brother of John, probably the Churchwarden, was on April .30th, 1599, engaged in hedging in the West Parish field of Churchill with his brother and William Dyson, a servant. They left William at his work. As after some time he did not return to the house, John asked where he was. No one knew. They went to look for him and found him dead on a ditch bank 23 paces away from his work. It was supposed that as a shower of rain came on William went for shelter under the hedge, and while there had a fit (he is said to have been subject to the falling sickness), fell into the ditch and was drowned. Notice was given to the Coroner. He did not hold an inquest, but sent orders to the constable that if, on seeing the body, three or four of the most substantial neighbours should be of opinion that falling into the ditch in a fit was the cause of death the Minister of the parish might order the constable to bring the corpse for burial to the church- yard. The substantial neighbours found that the fit was the cause of death, so next day the body was interred in the churchyard and the burial service read over it, or, as the Register says, " committed to the ^' ground in hope of the blessed and joyful resurrection, on Tuesday, the I St of May." The inhabitants of Churchill must have shared the usual fate of those who fixed the end of the world.

About six weeks afterwards another person was found dead in Churchill. The miller's servant had an illegitimate child. She said its father was a farm servant at Peopleton, but the Churchill people believed the father was the miller. The Rector in his account adds " (but God "knoweth). " Three days after the birth of the child the unfortunate mother was found drowned in the mill stream. This time the Coroner considered an inquest to be necessary. The jury found that it was a case of suicide, so the rubric that directs that the service for the burial of the dead be not read over a suicide was observed and the rule that was in force in those days was put in practice, the body was taken to a highway on Churchill Heath. It should strictly have been at cross roads, the body placed on the ground, a stake driven through it, and a heap of stones laid over it, so that " the erring sister's shame " might be duly re- membered. Very different was the way another case of found drowned was treated on the 17th April, 1594. Dorothy Tanner, the daughter of Thomas Tanner, by misfortune was drowned in a pool adjoining to a close of his house, and buried the day following, viz., on Thursdaie.

The Rector Rawlinson was a man who used the Register as a record of his views. Unfortunately, they were not always clearly ex- pressed as in the case of the Tandys, who had a daughter privately christened on the 25th April, 1589. The entry runs : " James Tandy " and Anne his wife had a daughter privately baptized but not formali " which baptizing of women I pray God may be removed and buried "the same day named Frances."

Whether the Rector carried his ideas into practice is not certain, but it would appear he did, as on the 7th Feb. 1596 this entry occurs in relation to the same persons. " Anne Tandy and her young innocent " a woman child the said Ann being the wife of James Tandy was " buried." No entry occurs in the Register of the " young innocent's " baptism.

Rawlinson seems to have had a family among which were several daughters. He is most careful to record all he could about their hus- bands, possibly to show the untruth of the subsequent criticism of

Eachard, which was the basis of Macaulay's celebrated attack on the 17th Century country clergy. It is fortunate for us that he did so, as he enables us in several cases to check the lists Nash gives, which have been universally adopted as correct lists of the Worcestershire parochial clergy.

Rawlinson's first wife was Maud, the daughter of William Acton, of Elffilde, gent. She died in December, 1583, and was buried at Churchill. He married a widow in six months, Katheryn Staunton, on the 18th May, 1584. It is a curious coincidence that the burial of his first wife and the marriage of his second are two con- secutive entries in the Register. Rawlinson clearly had a family by his first wife, for in 1586 the entry of a marriage of one of his daughters occurs.

" Thomas Lenarts clerke vicar of St. John in Bedwardine *' Wygorn and Johane Rawlingson the daughter of John Rawlingson ** clerke were lawfully married the xxviiith daie of November."

No mention of Lenarts or any similar name can be found among the incumbents of St. John's in Bedwardine.

The next daughter was married in 1594, also to one of the Wor- cestershire Clergy.

*' On Mundaie the xiiiith of October Mr. Simon Pieke vicar of *' Upton Snodsbury and ffrannces Rawlingson daughter to John Raw- " lingson clerke were lawfuUie marryed having suffitient dispensazion "" from the ordinary."

Simon Pieke was instituted to Upton Snodsbury in 1592 and appears to have held the living until 1597.

Another daughter was married in 1598 to the vicar of Spetchley, another adjoining parish to Churchill.

" On Sunday the xiiiith daie of January Mr. Richard Forde " Batchler of Artes Parson of Spetchley and Elizabeth Rawlingson *' daughter to John Rawlingson clercke were lawfullie marryed in the *' face of the church."

Richard Forde was instituted to Spetchley on the 17th October, 1598, and married on the 14th January following. He appears to have held Spetchley until 1627.

In 1606 Rawlingson lost his second wife Katharine. She died on

the 26th May and was buried on the 27th. The entry says of her :

** Who departed this mortall lief to imortall the daie before between ** 7 & 8 of the clocke in the morning."

Two other entries from the Register during the time of Rawling- son may be cited. He did not confine the Register to marriages in his own church but included marriages of parishioners in other churches. For instance there is the entry of the marriage of Nicholas Banford and Joan Cook, on the i6th October, 1691.

" Nicholas Bamford and Johan Cooke of the parish of Upton Snods- " bury were marryed at St. Andrew in the County of Worcester by Mr. " Clement Tasky mynister then by a licence obtained from the ordinary *' the Banns being but once published in their parish churche which *' was the xth day of October before for what secreat cause God ** knowethe."

The parties were quite within their legal rights to get married by liecnce even if they had had the banns put up, the granting of a licence being sufficient authority even had there been no banns at all.

viii. Parish Register.

The Rector's suspicions as to a secret cause, if they rested on the fact of incomplete publication of the banns, were no reason for setting aside a valid marriage.

Another case of the marriage of persons who apparently had noth- ing to do with the parish is found in 1596. " On Satterdaie the xv " daie of January Rychard Kynges & Ann Penson were marryed at ** Grymly by Mr. Byrch minister there having dispensation from the "ordinary." No Byrchs appear among Nash's list of the Vicars of Grimley.

Rawlingson appears to have regarded the Register as a means of recording anything of importance, at least this is the only ground on which to account for the following entry in the year 1595 :

" On Tuesdaie the xviii daie of November Rychard Larder of the " Parryshe of Upton Snodsburie did giv freelie and assigne all his " landes whatevere to Rychard Syny als Page and his heyres for ever as " may appear more plainlie by the evidence thereof and the wit- '* nesses thereunto annexed Anno Regni Reginae Elizabethe xxxviii,"

Rawlingson was buried on the 22nd September, 161 1.

The last of the Rawlingsons connected with the parish appears to have been Ann Rawlingson. An entry occurs in 1661 of the burial of a Mrs. Ann Rawlingson, widow, in the following eulogistic terms :

" Mrs. Ann Rawlingson widow was buried January ye 9th. She " gave ye west window in this church : and in her life and at her " death was charitable to the poor of the parish. She gave also ;^5 "by will to place out a poore childe of this parish for an apprentice.'*

It seems most probable that this was the lady over whom the in- scription was placed and the copy in Nash has the wrong date.

In the account of the Church in the Victoria History of Worcester- shire* it is said: "The two-light west window is modern." But in the picture of Churchill Church taken from a drawing about 181 o, in the Prattington collection, the window appears to be a three-light and not a two-light window.

Robert Whilbie, who was Rector of the parish from i6ii to 1613, only made 10 entries in the Register, all purely formal, 4 Marriages, 4 Baptisms and 2 Burials.

Thomas Barker was the next Rector, 1613-1654.

From an entry in i6i6 of the baptism of John the son of William Abbington and Elizabeth his wife, on the 29th of November, it would appear that the Habbingtons either resided in or had some connection with the parish in that year, although it appears that they sold their property in the parish about 1550. None of the entries for the first few years are of much interest. Francis Warr of the parish, who was buried on the 29th January, 1621, is described as " a man of great age," and in 1625 John Bamforde, a very aged man, was buried on the 30th May. In 1627 John Page alias Synger died and was buried on the i8th July. The Register is made the record for perpetuating the charities left to the parish, and this deals with John Page alias Singer.

" The said John Page gave by his last will and testaments the sum " of forty shillings to be kept in a stock for the good of the poore of " the parish of Churchill to be disposed of by the advice of the parson

"of the parish the overseers of the poore and two of the chief of the " parish yearly and the benefits which shall arise from the money to be "bestowed upon the poore upon the Thursday before Easter."

Then follows the statement :

" Memorandum that upon the feast day of Simon and Jude being " the 28th day of October anno domini 1627 Elizabeth Page widow " lately ye wife of John Page above named delivered the above named " forty shillings to be bestowed and disposed of according to her hus- " band's will into the hands of me Thomas Barker rector of Churchill "immediately after Morning Prayer in the presence of all the " parishioners then at morning prayer and the same 40 shillings " presently delivered to William Sowley of Churchill Grove and a land "taken of him for the use of the poor."

Mrs, Page alias Synger did not long survive her handing over the money. The next entry but one says :

" Elizabeth Page alias Synger widow wife of John Page alias " Synger lately before deceased was buried the 3rd day of February anno " supradicto. The said Elizabeth gave 20 shillings for the good of the "poor at Churchill which was delivered by Edward Ganderton nth "April 1629 to William Soley above named."

Unless the money is now represented by an acre of land in the glebe, the rent of which goes in paying the clerk's salary, this is one of the charities that have disappeared or become merged in the great Barker Charity.

Another case of suicide is recorded in 1627, a man, Nicholas Maul- tyne, hung himself on the 24th December and was buried in ye highway ye 26 December.

In 1640, Joan, the daughter of John Whiteley and Elizabeth his wife, was accidentally drowned, and was buried the 24th May.

The most interesting fact in connection with the Churchill Registers is that there is no break at the time of the Civil War. The entries run on continuously with the exception that no entry was made in 1647, and the only entry in 1646 is the following :

" John Bamford of Churchill died at Pershore under the surgion "being wounded by a soldier and was buried at Churchill the nth " August 1646."

It is difficult to fit this entry in, as all the fighting was over before the nth August. The siege of Worcester, the only place that held out for the King, had ended by its surrender on the 23rd of July, when the garrison and civilians marched out to Rainbow Hill and were given passes to depart. Probably some of the soldiers remained behind, for on July 24th General Rainsborough ordered all the Royalist soldiers to depart the city within three days. This would make the departure of the last the 3rd August, and it might well be a Royalist soldier on the road home along the London Road passing near Pershore, for some cause or another cut down an obnoxious peasant, who was taken to Pershore, operated on by one of the surgeons, and died from the effect of the operation, removed to his home, Churchill, and buried there on August nth.

The other Civil War entry is more easy to identify. "1651. A " soldier which quartered with Robert Paddy was buried the 2nd day " of September."

At the end of August, a body of Fleetwood's men marched from Stratford-on-Avon towards Worcester through Alcester. At the bridge at Upton Snodsbury, about two miles from Churchill, they were met

by a Scotch picket that was watching the road at the bridge over the brook. Here they were charged by the Scots and put to flight, and it is most probable that one of the Parliament troopers retired to Churchill, and died in his quarters there. His burial was the day before the Battle of Worcester.

No other entry of any interest occurs during the term of Thomas Barker.

His successor, Jaspar Brittaine, held the living from 1654 to 1668. His appointment to the Rectory and the questions arising upon it have already been mentioned. None of the entries during his time are of much interest. In 1662 there was no baptism, no marriage, nor burial in the parish. In 1663 Margery, the wife of Robert Paddy, probably the man who took in the soldier who was buried the day before the Battle of Worcester, was buried, and Robert Paddy himself in 1670.

The next Rector, William Moreton, held the living from 1669 to 1678. In the 26 entries that are recorded in his time there is nothing of interest except the baptism in 1676 of William, the son of John Hobbins and Rebecka his wife, who was baptized on the 8th of March, and is very likely the Churchill man, William Hobbins, who formed one of the gang who committed the Bretforton and Upton Snodsbury murders in 1706 and 1707, the forfeiture arising in respect of which caused the then Bishop, Lloyd, to endow his school in Worcester. Moreton is however remarkable as being so far as is known the only rector of Churchill who became a Bishop. He held the See of Kildare from i682-i70£: and Meath from 1705 till his death in 1715.

John Guest succeeded as Rector in 1678, and remained until 1711, when he died. There is nothing calling for notice in the entries on the Register during his time. During it the Act for burying in woollen came into force. The first notice of it is in 1684, when by a strange coincidence the first person who was buried in woollen was a weaver, William Solly.

The Rector lost his wife in 1687, and in the entry of her burial describes her thus : " Alice ye vertuous and most obliging wife of John " Guest rector of this parish was buried the 19th of March 1687 and *' affidavit made."

The children of Catholics could not be baptized in an Anglican Church, but the Rector determined to insert some mention of them. In the margin of the year 1698 is this entry in the register : " William " Baylis Papist had a child born."

The Rector lost his second wife in 1702. She is thus described in the Register : " Mary the second wife of John Guest Rector of the " Parish a pious and provident matron and one of the best of mothers "in law was buried the 25 October 1702 and affidavit made." The character " pious and provident " applied to a mother-in-law may not have been descriptive of domestic happiness.

Guest seems to have been particular as to all forms being strictly carried out. This will be seen from two entries. One as to a child that had been privately baptized the entry is thus made :

" 1706. Sarah daughter of John and Jane Portan. Born and ** privately baptized 26 December baptized on 27 December brought to *' Church and in prayer certified that all done according to prescribed "order of Church."

The other as to a wedding :

" 1709. George Jew of ye parish of Himbleton and Mary Brinston "of ye parish of Tibberton were married ye 23rd of November having "first received from each parish a certificate that the banns were thrice "published."

John Guest was buried on the 4th December, 1711. On the same stone were inscribed : §

" Mary the wife of John Guest rector of the church a pious " prudent matron died Oct. 24 1702.

" Alice the virtuous wife of John Guest Rector of the Church died *' March 16 1678 aged 36.

" H. S. J. Johannes Guest Hujsce ecclesias rector, provinciam suam " ornavit, Dei gloriam propagavit, animam suam liberavit ex omnibus. " et hoc tantum caeteris major quo melior. Tandem Deo gratus proximo ** charus piam exhalavit animam primo die Decembris AD 171 1 " aetatis 63."

Guest was followed in the living by Henry Barton, who held it from 1712 to 1746. His first entry states that he was given the Rectory when he was only 27, " anno aetate suae 27 mo." His tenure of the Rectory is noted in the Register by the marginal notes he inserted as to the exact hour at which each of his children were born. Possibly he believed in Astrology and desired to give them the means of having their horoscopes cast if they so desired. He had been at Churchill five years before any entry of the baptism of any of them appears. On the 15th August, 1717, the baptism of his son Henry is mentioned, and in the margin is the note " Nat: Aug. 3 circa i mam mane."

The last entry as to his children is in 1734 and records the burial of one of them, but the note is careful to account for the fact why the birth is not in the Churchill Register.

"Sex dies natus affdt. Hie puer natus fuit et bapt. Vigorn."

It is of interest to see how careful the Rector was to observe the law. The six days old child was duly buried in woollen and the affi- davit that it was so, produced.

But so far as entering in the Register the fact of the affidavit as to the woollen shroud the practice from about this time gradually died out. The last entry of it in this Register is in 1745, although the Act was still unrepealed and the lines by which it is now chiefly remembered in the speech Pope* puts into the mouth of the actress Mrs. Oldfield *' Odious in woollen," had been only written a few years before.

In 1743 an entry occurs of a family who possibly were Baptists. On Easter Tuesday in that year three daughters of a family named Munslow, aged respectively 7, 6 and 4, were baptized. Another daugh- ter, whose age is not given, was baptized in October, and what appears to be the father himself, John Munslow, aged 31, was baptized the next year.t

In 1746 Gilbert Heath succeeded to the Rectory. He did not share his predecessor's objection to private baptism, for from 1749 all the baptisms but one were "private."

The last marriage entered in the old Register was in 1750. The bridegroom, John Hemus, came from Stoulton, and the marriage was by licence. Years afterwards Lord Hardwicke's Act was passed which required a separate Register book to be kept for marriages. This book, which forms Volume 11. of the Churchill Registers, begins in 1761.

In 1781, George Dinely became Rector. He appears to have insti- tuted a method of keeping the Registers of Baptisms and Burials in a

Nash II., p. 313, gives no vicar of St. John's in Bedwardine between Edward Barker, who was presented in 1572, and Thomas Arch- bold, presented in 1620. But as Barker was presented not by the Dean and Chapter of Worcester, the patrons, but by James Higgins and Robert Traughton, of St. John's, as grantees of the Dean and Chapter, it is quite possible that Lenarts was the resident priest in charge of the church.
