« shipper may deliver at purchaser’s expense and risk. Any stock omitted by mistake to be
supplied free of cost. In case any of the varieties bought cannot be supplied, others equally
as good may be substituted. In no case shall errors render the seller liable for any sum of
money greater than that originally paid for the stock. All fruit trees that fail to live, with
proper care by purchaser, are to be refurnished at half price, provided notice is given, not
later than January Ist, accompanied by remittance. This constitutes the entire agreement

and is not subject to countermand.
