A proper copyright notice (USA) needs 3 things: the word copyright or its symbol ©, a date, and a name. As far as its GATT eligibility, I have no idea.

Thanks for jumping in. I know this is the rule for US films but this GATT thing makes it a different ball game. Mystic550 says this movie was never registered so it might squeek by. We'll see. I'm going to be out for the weekend so it's going to be a day or two before I'll be able to put it up anyway.

This film was first published outside of the USA and not published inside the USA until 3 years later. Its copyright holders are not American, so it is eligible for GATT. If no NIE has been filed, then it might "squeak by" but if it has or if it has no copyright notice then it will not squeak by. Note that for GATT eligible films, under the currently applicable rulings not having a copyright notice means that the film is not PD. The objective of the GATT treaty allowing films to regain copyright status was to allow works that had been incorrectly registered, had invalid notifications or not registered at all to regain their copyrights because the requirements had been unreasonably difficult (from an international point of view). So an invalid notice has no bearing on GATT eligibility

OK, thanks for the info. I generally have one rule I follow when I upload, and that is when I have any doubt at all about a film's status I'll refrain from uploading it. So I think I'll hold off on this one for now. If Video Cellar or Moongleam give me any word that it is PD, I'll put it up. In the meantime, when I get home to my own computer, I'll put up "The Yesterday Machine", and you should see it here by tomorrow morning. Hope I get some confirmation on this one, though.

It'd be nice if Video-Cellar would comment, and clear up whether it has been GATTed.
